  • As far as we know (and that isn't much!) he doesn't have anyone else. He's currently living back with his mum, but has said he'll only do that until June/July at which point he'll go into rented accommodation if she hasn't sold the house to free up his part of the money.

    His income is £24,000 a year. Does the CSA work it before of after deductions??

    It will be 25% of his income then
  • He's not willing to pay more than the £70 a week. Does the maintenance have anything to do with what she gets from house sale or are the two totally separate.

    They are barely talking now, its all getting very messy. He's said if she doesn't take the £70 she'll get nothing at all. Nothing is in writing yet and she wants to get it right first time to secure the kids future for them.

    If she is on IS then she will only be able to keep £10 a week anyhow, and will have to go through CSA unless she got extremely good reasons not to. The share of the house has nothing to do with maintenance.

    My friends soon to be ex has offered £70 per week for them, breaks down to about £23 each. He has said that he won't give her any more, nor will he pay for school uniforms, school shoes, coats, school trips, play school (child under age for free sessions), out of school clubs etc. Basically, she has to cover everything from this £70 and her family allowance.
    If your friend's ex does eventually pay maintenance for the children, either through the courts or through the csa, he isnt obliged to pay for any extras as that is what the maintenace is for.

    My ex pays £52 per week through the csa, but as im on income support I only receive £10, but its better than nothing :confused:

    If she claims IS yes
    If she is on IS she will only get to keep £10 per week of any maintenance

    Best bet would be to come to an agreement and avoid the csa if possible :cool:

    If she is on IS she cannot make an agreement it has to go to the csa
  • She also has her working tax credit that is related to his wage. I'm guessing that stops now she isn't with him.

    So would I be right in saying that basically each week she will get family allowance, income support and £10 of the maintenance.
