Capital One - Payment plan problem

Has anyone had problems with setting up a payment plan with Capital One?
In September 08, we found out my Wife would not be paid any further maternity pay for 6 months, so I contacted C1 to ask if I could set up a plan for the 6 months. They sent me out an income and expenditure form and gave me 28 days to return it. Having done so, I chased them up to see if it had approved my request at the end of October. they told me there was a backlog in processing, and I had a default notice due to be issued on the 8th November. But as there was the backlog in processing paperwork, they would hold the notice. The notice was issued anyway and I was told, I had to pay the notice or I would get a 6 year bad credit rating and they would sell my debt
On the 5th Dec I paid the notice, and was told I had to re-fill in the forms they were sending me. I had 5 days to receive this and 5 days to get it back. It was up to me to make sure this happened. If it didn't, a second default notice would be issued and I would not be able to buy out of that. I asked why my old doc could not be used and they told me I had to fill in new ones as it was a new request - the old ones could not be used.
5 days passed, no forms, I called and called, but I could not get through to the dept, collections couldn't help me it had to be this unit. On the 24th Dec finally spoke to someone and they told me the forms would be sent out & I had 28 days to return them.
Friday 2nd Jan I rang as I didn't have the docs and they told me I couldn't request more until this weds 7th, they could have used the original docs back on the 5th Dec, but now they can't. I was concerned about another default notice being issued, but they kept telling me there wasn't one pending.
I then had a call 1/2 hr later from the collections dept and I explained to them I'd spoken to someone in the specialist support unit, but I was willing to make the proposed payment & did so.
I received the docs on Weds 7th and sent them back yesterday.
Tonight, I've had another call to say they issued a default notice in which I have to pay a large amount to clear again. The 2 dept don't talk to each other, I have asked to speak to senior manager in England - all they can do is put a note on my file I have requested this. I am furious with them as I don't get anywhere with them and they just keep ringing.
Any ideas please?
