Help.....Tennancy issue

I really need some help on an issue with my landlord which has been going on since November last year.

At the start of November a car drove into my kitchen wall and the driver ran off. The landlords insurance covers the building work required which is quite extensive. My family have been living in this property since the accident paying full rent even though the kitchen is damaged and the front door is unusable as it is now wedged shut. To date my 6 year old has injured herself 7 times on exposed metal and wood in the kitchen caused by the collision.

The landlords insurance will cover my landlord for the loss of rent when the building work begins (next week) but not alternative accommodation for myself and my family. The whole front of the house is being rebuilt along with the kitchen so we have been told we will have to move out obviously as the property will become a building site.

My landlords insurance will not cover the alternative accommodation and my contents insurance will not cover it even though it clearly states in my policy that i am covered for this.

I have been told that my property will not be covered when the building work is started as the property cannot be locked at night therefore anyone could walk in and lift our belongings with ease.

I have been told that i am supposed to find alternative accomodation and storage for my belongings with the months rent i wont have to pay (£950-00) but this is clearly impossible.

Can anyone point me in the right direction as to who i should speak/complain to as my landlord has said it is not her problem?

  • Very unfortunate, as it's neither your fault or the Landlords. The LL isn't under any obligation to provide alternative accommodation, only reduce the rent to reflect a fair proportion of occupancy (nil occupancy = nil rent).

    My landlords insurance will not cover the alternative accommodation and my contents insurance will not cover it even though it clearly states in my policy that i am covered for this.

    If it clearly states the event is covered, why won't your insurers pay out ???

    if the landlords insurance covers the loss of rent them negotiation should be possible where you do not pay rent but have the funds to cover alternative accommodation But do not move out until you have it in writing that you can move backin as soon as work completed, you do not want to be found to have surrendered the tenancy.

    Possible alternative accommodation could be found through the housing departmetn as technically you could be considered temporarily homeless as your accommodation is unsafe to live in due to the accident and because you have to move out for the repairs to be carried out, this could be backed up by the injuries to your child. Accommodation may be in a hostel but would be short term until you can move back in.
