    But s/he will want to know where the cash went - if you paid a large amount to your father and don't explain what it is, they can try and get it back from him.

    It certainly looks like you could possibly be getting a BRO, for using credit knowing you couldn't afford to pay it back, and favoring one creditor over another.

    The OR doesn't need to know when yoy decided to go BR, he will look at your statements and know that you used credit while having no reasonable means to repay it.

    He won't know you paid your father off, but will ask you what you spent all that money on, and will expect to see some sort of trail. That's an awful lot of cash to take of CCards prior to BR, the OR can't just over look it. If it was £600 you could have said it was food etc, but £6k, phew.

    The catalalogue spending for your new home is the least of your worries.

    the money was taken from my husbands card and we are now seperated. going bankrupt seperately. what is a bro? my rental property is taking all of my wages i cant pay anything

    Hi angel,

    Don't panic,
    It is a restriction order/undertaking from 2 -15 years depending on how it is set up - here is a link that explains it.
    It doesn't mean you have to pay anything - you can't pay what you haven't got, remember.

  • If the money was from your ex CC then you should not worry. It is YOUR credit history the OR will look into your ex CC has nothing to do with you its his credit not yours.

    Angel, we're not trying to scare you into not doing anything. But you need to get some proper advice asap. And regardless of who the card belongs to, you need to stop buying things.

    If you are having problems paying your rent, etc have you checked out https://www.entitledto.com to see if there are any benefits you can get? I haven't seen many of your other posts so I don't know if there are children involved or not :confused: but you may be eligible for assistance.

    In order for the advice to be clear, can you do an SOA on just your income and expenditure, and only your debts. Then we will have a clearer view and can help you better.

    If the credit card you used was your ex's, and not a joint one, then the debt will fall to him. If you are both going bankrupt then he will have to explain where the money went, but again, the OR can try to get it back.

    And as Peachey says, there may be some oncerns about you favouring a creditor, which basically is about you paying off the car when you knew you were going BR.
