Please someone who has been through BR

I am having a panic. i am planning to go Bankrupt in february. can someone tell me exactly what they do. i know you go to court and after you are BR you speak to the OR. What does he look into? does he physically go into your accounts and look at statements? i am worried as i have been buying stuff for my new place for catalouges- no plasma screen just other stuff im scared he will want to see statements etc. I wasnt planning to take statements. will he obtain statements himself???/

    not been but if you have been buying stuff you may want to try surviving for another 3-4 months!

    Ok when you go to court you ony take your SOA and money. The OR will send a pack asking for the last 12-24mths bank and credit cards statements. If you don't have them he will get copies himself. He will then go through all your debts with you when he does the interview.Dx

  • hello angel as dalip said the OR can get any info on you they want so dont worry if you dont have them, they just ask as its easier for them.

    i know alot of people have still spent on cards (for basic living expenses like food and even br fees which has been allowed) but not sure on cataloges right before br as mine was a few months but i would calm down on the spending on silly things as it does come under the spending credit when you know you have no way of paying back.

    firstly dont panic. i went br back in october as was feeling tha same as you.
    my local court have a drop in system so no need to book a date, also thay had a member of staff from one of the debt charritys.
    on the day of br i took my forms (3 copys) that i had filled in online and my money (just under£500).
    arrived early and booked myself in with the court, we was thinking it would take the best part of the day. after about 15mins we was asked to see the debt charity man who just looked at the paper work and filled bits in id done wrong. he then took us to see a court usher who delt with the br. very helpfull and very plessant.
    we then swore on the bibble paid and left.
    the court usher phoned me at home the next day to say it was all done an the judge was happy with it and the or would ring within 5 days.
    the or rang to arrange a interview over the phone and when he rang it took around 20mins. he then sent a pack asking to sign and any creditors papperwork and 3MONTHS bank stattemants. around 4weeks later we recived somemore paperwork to sign regarding the house (land register)
    we are just waitng for what ever comes next?
    as for you spending money on house things as long as you havnt spent£10000s on tvs stereos and just withdrawing money and waisting it i cant see any problem. you can say it was to pay bills or you needed new bedding ect

    Angel make sure you get yourself signed up to the Freecycle network https://www.freecycle.org . You express an interest in something and then if you are chosen you can pick it up for free.

    Totally agree about Freecycle - Last year I managed to get a fridge,washing machine, Brand New shed and a laptop all for free from freecycle. It's saved us lots money (that we didn't have)!

    The thing is when we new we were going bankrupt we took cash off credit cards paid my car off and then took off more to get a deposit for a rental this totals 6 grand then there is the spending i have done to kit out my new home. no plasma screen tho. he will see those withdrawrals from 5 different credit cards and think we have money stashed he will want to see where the money has gone. also i am getting an injury claim through for 1600 in the next two weeks, I am giving it straight to my mum as i owe her it. The or will think im stashing the cash. I am so terrified i feel like i cant even take this route now and i should just not do it but really i have no choice, what can they do to me if they think i am being dodgy???

    He will look closely into what you have been spending the money on, and you need to ensure that you have a clear paper-trail. The main problem I can see is that knowing you were going bankrupt you obtained further credit. The rent might not be such a big deal, but paying off the car, etc may well be frowned on.

    Not sure what happens about the £1600. They may not allow you to keep it - can't quite remember the rulings on industrial injury claims :confused: - and if you have given it to your mother, they can try to get it back from her.

    Is it just you or both of you going BR? As you need to remember if they are joint credit cards, and it's just you going BR, your OH will be liable and chased for the money.

    If they think you are being dodgy, they can apply a BRO which can last up to 15 years. I will see if I can find a link to details. Have you taken advice from one of the free charities? If so, it might be worth talking to them again to find out how all of this additional spending, etc will be looked at.

    they dont know we had decided to go bankrupt and then he left me in december and things got worse. he wont know i have paid my car off as it was loan that came out of my pay through work not a credit agreement etc. and i paid cash into my fathers account and he wrote a cheque to pay off the car loan
