Egg money, section 75 protection?

I have an Egg money mastercard, I use it for everything and pay it of in full every month to get the cashback at the end of the year.

I have been thinking recently though (with all the nonsense that is going on with retailers) if I made a bigger purchase and the company supplying the goods went bust I would have entitlement to a claim under section 75.

Am I correct that I would have protection? It is after all a credit card isn't it?
Or does the egg money card come under some other classification that would not give me protection under section 75?

Yes, use it as a credit card, you would have section 75 protection on any item over £100

I'm sure someone has said on here before that it would only count if it was used as a credit card, i.e. you did not have a positive balance after the transaction went through. I may be wrong though ...

Knew it was here somewhere! This post is what I was thinking of: http://forums.moneysavingexpert.com/showthread.html?p=14607139#post14607139

So, if you have a +ve balance and try to claim, whether it goes through or not "all depends on what you are claiming for and why", which is about as vague as a statement is possible to be! But if you're using it as a 'normal' credit card (i.e. in a negative balance) then you certainly should be covered.

  • Thanks for your replies folks;)

I never have a positive balance on it, so I always use it as a credit card.
Thanks for the links, I think Egg's answer was a wee bit woolly!
I signed a credit agreement when I took the mastercard from them so I can't see how they could not comply with section 75.
I've had a look on the EGG money website and they don't mention anything about it, but then it wouldn't be in their interest to draw attention to the cover would it!

Thanks, I do feel more confident with the protection.
It's just the niggling thought that there is something lurking in their T's and C's that would stop a claim.....

It's detailed (although they don't specifically refer to it as "section 75") in your credit agreement...
IMPORTANT - READ THIS CAREFULLY TO FIND OUT ABOUT YOUR RIGHTS

The Consumer Credit Act 1974 lays down certain requirements for your protection which should have been complied with when this agreement was made. If they were not, we cannot enforce the agreement without getting a court order.

The Act also gives you a number of rights:

    1) You can settle this agreement at any time by giving notice in writing and paying off the amounts you owe under this agreement.

    2) If you received unsatisfactory goods or services paid for under this agreement, apart from any bought with a cash loan, you may have a right to sue the supplier, us or both.

    3) If the contract is not fulfilled, perhaps because the supplier has gone out of business, you may still be able to sue us.
