HIPs on reposessed houses?...

Hi, my partner and I are trying to purchase a reposessed house.

We have been to the property a number of times and have made an offer (subject to survey).

It has only recently occured to me that we have not yet received the Home Information Pack for the house from the EA.

I was planning on going to the EA tonight and requesting it, but I just wanted to make sure that since its a reposession, there wasnt any differences in the EA's responsibility to provide a HIP to buyers/possible buyers?

I assume HIPs are mandatory and thus it should have been done?

There wouldnt be any reason for them to not have to provide me with one is there?

Any advice would be most appriciated! :D

    We had an offer accepted on a repossession, and the HIPS was sent direct to our solicitor by the estate agent. The solicitor then forwarded us a copy.

    Funny enough - I rang the EA today because I also haven't had a HIP for the house I put an offer in nearly 4 weeks ago. Seemingly it's not coming until Tuesday. I did buy the house 2 days after it was put on the market but I'm sure, by law, the HIP has to be in place before the house goes on the market now. Oh well - not too bothered. I would have liked to see the EPC but I know they've just had cavity insulation done over christmas - so it's probably out-of-date already.

    from what i've heard, it's fairly common for EA's to do the HIPS after the house has gone on the market.

    We've had our house on the market now for 3-4 weeks, and the EA still hasn't done a hips, but we don't mind because we're taking it off the market now.
  • We just bought a repo and If we wanted the view the HIP before we completed we had to view the HIP at the EA's office; on one of their computer screens. Not sure if thats common practice :confused:

    jeez, talk about blaming the e.a for everything, its the vendors responsibility to get a hip, the e.a just cant market the place until confirmation of order for the hip has taken place, they dont physically need it they just need to know its been ordered with a solicitor, hip company or yes themselves.

    And regardless of whether you have actually got the hip in your hand you will still have to pay for it so dont be too happy about withdrawing your property.

    Yes it is. The hip is the property of the vendor and a lot of places charge up to £30 for a copy to give out.

    That said a lot of places just photocopy it for free too so i guess its luck of the draw.

    A buyer wont get the HIP without asking, it will go to the buyers solicitor. Some agents will ask a potential buyer if they wish to see the HIP but most buyers never ask or dont care. I know of one case where the HIP clearly stated a covenant on the title register that the buyer was unhappy with and pulled out, after running up a bill from there solicitors. It pays to look!

    I had to go in to see the EA about the HIPs on the repossession I'm buying.

    He told me we couldn't have a copy of it as he had to pass it on via our solicitor but logged on to a PC and let me sit and read it.

    Our EA has been great....it's getting the mortgage advisor and the lending bank to talk to each other that's the problem!
