Even if they've been successful in the course? How would you know if they'd signed on or not? And assuming that they signed on and the PWC didn't let the CSA know and the NRP kept paying the agreed support amount what would happen when it all came out in the was, if it came out in the wash? Fraud charges?
This seems to be a quite common problem. The child is not elegible for child benefit but some PWC's continue to claim therefore entitling them to CS as well. If the NRP has been excluded they have no way of knowing. Even some who do have to fight tooth and nail to get the CSA and CB to act.
And to answer your question the chance of prosecution is miniscule !0 -
I have been checking since sept 08 and keep getting told that CB is in payment til Sep 09 (19th birthday), but I know that said Child/Adult is doing NO further education I even gave CB his myspace page, facebook etc and also proof and times and dates when he should be in FE but was out and about , reported CB fraud, it is common knowledge round our town that this kid is not studying and he is open about it and still nothing done!! He even goes as far as t brag that we are funding his "lifestyle" til he's19 (draw your own conculsiions to what that entails :rolleyes:) So basically anyone can claim CB without doing or prooving the FE and nothing will happen to them. We are scared to ask CSA to call NRP because of repercussions, it appears that this PWC won't have her cash cow dry up!! We are basically paying til age of 19 for this one and it won't cease til second week of Sept!0
