Hello there,
Please can you help me, i got a ticket from euro car parks in October. I have ingored the letters that they have sent me, Nowi have a letter from Control account credit management saying it's a legal Requirement to send notice of an intention to make a civil claim before that ciam is issued. If i don't pay they will either send bailiff, application of earnings, Court to be orally examined or application for a charge upon property. I have a search on line to try and find this company but i coundn't find anythink.
What should i do, pay or stand my ground. Just starting to worry about it now.
Please Help:huh:

I think you will need to put an exact wording of the letter before anybody can really help.
They however need a court order before they can do anything to enforce payment. They cannot send in bailiffs, obtain charge on your property prior to obtaining a CCJ.
Have they specificly said they will be taking you to court?0 -
Thanks for your reply, please see below what the letters say's
This is your final chance to prevent litigation being commenced against you: if you ignre this warning then proceedings may commence and judgement will be sought. The cost relating to such litigation will be added to the amount claimed, together with interest at a statutory rate of 8%
If judgement is obtained and a order for repayment in full is granted the remains upaid then enforement of that judgement against you may be sought by any or all of the following procedures:-
Warrant of Execution by bailiff or sheriff against goods ot assets
Application for an attachement of earnings upon your employer
attendance in court to be orally examined as to your means and assets
application for a charge upon property, insurance policies and pension fund etc. which may be owned soley or with others
Thanks for your help.

All of those things they are threatening can only happen if ordered by a Court, except the "charge on property" which is the figment of someone's imagination.patterdale2000 wrote: »... That's how their scam works, by trying to scare people into paying. They will probably follow this up with a "final warning" in red ink. If you don't respond to that, you may get a "final last warning", with an official-looking chequered border round the page.
The only thing worth responding to is a Court Claim, issued by a Court with a proper stamp and reference number. But Euro Car Parks have no evidence of the driver's identity, so would not be able to enforce such a claim. And there are no known cases of Euro Car Parks taking anyone to court, so I would ignore their rubbish letters, they will go away soon.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Thank you so much for your advice, I worry about everythink.
Happy new year
