I have to nod in full agreement with you there! People are not learning to take responsibilities for their own actions. I have to point out however that the companies are not helping themselves either - they are at fault for allowing the possibility of a debtor to write off the debt simply because they are unable to find the CCA documents or paperwork not followed correctly for it to become a void CCA.

    Finally, the penny drops!

Do carry on the good work guys, its always highly amusing to watch you get your knickers in a twist every time a suspiciously new member posts yet another "is this true..." thread.
The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts.

hi bert&ernie, hope things are well with u? I recall we had a discussion on this in another thread a while back do you remember? Just because there is no CCA doesn't mean the debt have to be written off. If this is the case, then there will be a serious crisis ahead of us.

No but it does mean they can't collect on it.
  • If you're saying that punctuation isn't unnessary, then why does it exist.

Anyway, I take your point that my comments didn't enhance the thread or help the OP. I just get annoyed that there are so many threads devoted to people simply try to get out of their debt responsibilities.

Perhaps I'm just old fashioned. I just think that standards are dropping generally and people don't take responsibility for their own actions.

so what you are saying here is, if you don't use capital letters and full stops in your posts on the credit card forum - you will be judged and criticised

get a grip man, this is the internet not an English class

seems to me that you and your saintly friend feel you are superior to posters who want advice on debt matters or who want to share their experiences

by attempting to "dumb them down" must give you some sort of twisted pleasure

standards are certainly dropping when it comes to respect and tolerance

yes true...however the debt will be still sold on etc. We have not heard anyone who have successfully had their debts written off due to void CCA? I do remember there was this couple who managed to written off more than 100K debts? however they were too greedy and eventually was stopped by the judge saying it is very obvious they are avoiding paying someone's else money back. So they ended up almost in the same position because they had to pay the legal fees!! What goes round, comes round!!

if you placed the account in dispute then the company cannot default or add charges etc or even sell the debt on...?. Take a look at this link and inparticular posting number 6 http://forums.moneysavingexpert.com/....html?t=963087 pay particular attention to the bottom half of the letter

"Whilst it is unenforceable, no interest is to be added to the account. No action can be taken against me. No adverse credit references or defaults can be listed against me with Credit Reference Agencies. The account cannot be passed to a Debt Collection Agency. And lastly, I am not obliged to make any further payments to the account. Essentially, the account is ‘held’ as it was on the date of the CCA request expiring (****, 2007)"

THIS IS A POST BY ME IN ANOTHER THREAD. Yes they got greedy noah for trying to get the legal fees written off. The fact still remains they won the claim.

hey noah I think you may be pulled up for punctuation here or is it only aimed at me?

have should have been has or there should have been an s on the end of debt

sorry for being pendantic but we must not let our standards drop :D

It is very hard for me to hear the ending words like HAS and HAVE and HAD. I always get them confused at times -the reason? I was born profoundly deaf. So grammar is not exactly my strongest subject!!
