My daughter gets EMA and DLA last year when we started college we were told we would have to pay £300 in advance for the year, she gets taxi to college which is a mile away. Before she went to college we paid nothing but she didnt get EMA then

We were told me LA that the EMA pays for transport, I said if it was a normal person and given we are only a mile away (hilly though) if I was her I would walk to college given she cant walk far we have to pay

She only got DLA last Jan 08

Persistence from parents and at the nearest college - Thinking about it I don't think he gets EMA so that might have been in his favour.

    LEA is North Yorkshire.

One thing you do have to remember is that your son is already being funded for transport through his EMA.

    thanks for the info
there is nothing nearer that can meet his needs. If he did not have these extra needs then he could maybe go somewhere local and use public transport but he doesnt have that option, which is my point really. The other lad u mention, if he doesnt get ema its because his parents have a reasonable income, thats not the case here. We have a 2 week reprieve while the solicitors sort it out, so will see what else i can find out. I just feel that the government guidelines do not take into account special needs pupils from low income families, whose options are very limited.
A statement is a legal document and whatever is in it is supposed to be provided.
My son also now informs me that the escort that used to travel alongside the driver has been withdrawn by the authority. No consultation with parents whatsoever.
  • similar here: statemented, but £180 for transport for my son....... to any local college not even a taxi but shared mini bus ..rip off in my opinion
    1. i'm bi polar.:rotfl:2. carer for two autistic sons.:A 3. have a wonderful but challenging teenage daughter. 4. have a husband that is insatiable. 5. trying to do an open degree.
  • My son receives EMA and has SENs. We live in West Yorkshire and his dad transports him to college then claims mileage back per month, as he did when he was in school.
  • my friend was awarded EMA £30 per week whilst claiming income support £90 a week, she was given this for 6 weeks then they decided she couldnt claim both and asked for all the EMA back, she contested it because it was their fault and in the end she didnt have to pay back a peeny

DLA is not for school transport, it is for the extra costs associated with being disabled. He would need the transport for school whether or not he was disabled.
Would be very interested to know what other councils policies are on this if anyone knows.
    thanks

As you have made very clear in later posts, your son would be using pubic transport and attending a closer college but for his disability.

Therefore, it seems perfectly reasonable to assume his DLA can be used to cover the additional transport costs his disability warrants.

With that and his EMA, he has enough to cover the transport and it seems wrong he should be allowed to keep all his EMA when other students have to pay transport costs if they need it, and lots do!
