How do you calculate part time employees holiday?

I am a part time worker, working 3 days per week. My contractural holiday is 24 days plus bank holidays (8 of them, I think). So I get 19.2 days holiday, which is rounded up to 19.5 as taking .2 days holiday is quite difficult - I think it is 1.5 hours... If you do end up with a partial day to take, the company can either round it up to the nearest half day, or allow you to take the partial day - they could insist that I take .2 of a day if they wanted. They are NOT allowed to round down - i.e. they can't say "oh, 19.2 rounded is 19 days, so you get 19 days" - it has to either be exact or rounded up.

    19.2 is 3/5 * (24 + 8)

With the bank holidays, if they fall on a day that I work I have to take them out of my 19.2 days. As I work Tue, Wed, Thu I had to take Christmas Day and New Year's Day (both Thursday) this year out of my pro rata allowance.

I believe it is illegal not to give you pro rata bank holidays, as it is discriminating against part time workers to not do so. And as part time workers are disproportionatley female, it is considered indirect sex discrimination to discriminate against part time workers.

    Hope this helps
