Help needed - conned into car finance, but my own fault

    Name the garage / dealership on here.........
    They may have been at this trick before.....might give you some ammunition to fire at them ???

  • Sounds like sharp practice to me. However, just because you signed a document that alone does not mean you have no option but to continue with the 'deal'. I would object very strongly, and be willing to take the matter to court. I would also make a formal complaint to the dealership, and contact trading standards for advice.

    Bear in mind that car salesmen are under strong pressure to sell right now, considering that sales are down overall we'll no doubt see more of these stories.

    I have no legal knowledge, but surely because its not a new car that you have ordered, then you can withdraw from the sale and just lose the deposit.

    Also, I know you may not have a cooling off period on the car itself, but surely you get one on the finance.....
    Am I allowed to name the dealership?

    Can't see why not. (as long as what you have said is true).

  • Dealership is Drive Vauxhall. Hubby just spoke to them, and the guy is really confusing us, he has said finance has been approved, but we don't have to use them, but to come in with offers we can get, and they'll try to match them. Am very puzzled because as far as I am aware, once you have signed at dealership there is no cooling off period. Also, he doesn't know which finance company it is through, and the finance manager isn't in today so nobody can tell us - was planning to phone them on trading standards advice to see if loan has been executed.

    start recording the calls - it's a bit dodgy legally, but sod that.
    also, I don't see how you can have committed to a hypothetical car - does it have a reg number on the docs you signed? does it give full details of the actual car?
    If not, I can't see how a contract has been formed. It would be an unfair contract under OFT guidance as it doesn not actually specify what you are getting.
    And them taking a finance contract for a non existant vehicle is extremely dodgy.
  • It does have a registration number on the agreement. The more I read my own comments, the more gullible I feel. Have never been to main dealership before, and he assured me that this was the best of two cars they were getting in, and I would have first refusal on it. I trusted the guy because it was a main dealership, but obviously should have read exactly what was being signed. I wouldn't have dreamt of committing to buy a car that I've not seen or driven, but apparantly I have.

    So, they sold you a car unseen?

    Did the paperwork have any more details of the car? Can you tell us exactly what it says about the car on the paperwork?
    Also, is the dealer a main dealer for a particular manufacturer? If so, which?
