Need some help with Egg Card payment

Hi guyz, not sure where if there is anything that can be done about my situation but here goes (sorry for rant but have to vent):
I cleared my Egg card over 2 years ago, never used it since, but kept it for an emergency.
Had a letter from them saying that i have missed a payment yesterday, which i thought was odd, so logged in to find a balance DR of £66. So i went through each month and found that in Nov 08 the AA had taken a £50 payment and that this month i had been charged by egg £16 for missing a payment, i had no email, letter about this payment, so there was no way of me knowing. Now The AA payment was weird as i am not with them, but after contacting them i found out (and remembered) that in Nov 07 my brother in law broke down close to where we live and came over and joined the AA from our house, but as he had solo, he had to use my card (The egg card).
Now of course as the AA just repeat the cover unless you say anything - thus the payment.
Contacted my Brother in law who apologised and said he'd give me the £50 and he'd keep the cover (and change the payment).
But what about the over charge of £16 - do i have a leg to stand on here to get this back, i know it's my fault in a way, but considering i never got a head up about the payment and the DD from the bank had been cancelled years ago. There was no way of me knowing of this?

I would say , swallow it, and put it down to experience. For further information, suppose the circumstances had remained the same BUT you had cancelled your egg card after clearing it, the payment to AA would still have been made and the penaltys against your account still have happened. Recurring card payments YOU cannot stop, nor the CC company, you have to inform the company, in this case the AA that you do not want the renewal when it is due, and they will stop the recurring payment.
Regarding the DD payment, you could claim back that payment from the bank under the Direct Debit Indemnity rule, as you had cancelled the DD years ago BUT that would only have the effect of Egg then wanting the payment from you.

I think your brother in law should pay you the £16.
If you don't want to risk upsetting family then you have to just swallow it.0 -

lisyloo - You hit the nail on the head, the wife spoke to him and did not want to mention the charge as he's just moved house and is skint (He's the baby of the family and if he mass murdered a whole town, people would still take pitty on him, one of those you know!
Looks like i'll just have to swallow this, i'll try it on with egg, as i never got a payment reminder until i got the missed payment letter - surelly this can't be right?0 -
Well the AA id refunding the money back to the card, so have emailed them to ask for the charges to be removed as i did not get any warning from them (no statements, letters etc) that i needed to make a payment, if i did i could have had the aa refund in November and no charges would have been applied.
Will wait until next Wednesday for them to reply, by that time the refund should be on the card.
Also - methusala -suppose the circumstances had remained the same BUT you had cancelled your egg card after clearing it, the payment to AA would still have been made and the penaltys against your account still have happened.
Can someone confirm this?

Also - methusala - Surely if i canceled my card, thus no account with egg whatsoever a recurring payment would just bounce into thin air as the account does not exist?

The account is 'ressurrected' and a new debt is created. This is why it's very important (as they tell you in the T&C's and closure call/card closed letter or e-mail) to cancel all CPA's when you cancel the card. Appreciate you hadn't realised you had one, but that's the danger of paying someone elses bill on your card...and can be an absolute nightmare if you move address in the interim.
I've previously paid my son's car insurance on my card, but I made doubly sure they hadn't retained the card details for auto-renewal.

Wow, really shocked at that that the card can be reopened for the payment.
I'd better get my brother in law to double check my details are off the system!
I had cleared this just after i moved, so updated my contact details, imagine i had cleared before, they would not have any of my details as mobile, email, address had all changed, i could have racked a mega amount of unpaid charges. Not sure how they would get me to pay though, maybe get a debt collection agency to vist my old address, ask the neighbours, then get me new one and take my TC and Car away!!!!!

Well a bit of a result - power to the people and all that. after a few heated online messages, i have had the charges refunded
