Why do you think that it was mis-sold?

Hi hun
We had this case about these resolved through the Financial ombudsman service where ALL PPI plus interest etc was repaid back.
We were forced into taking this to be able to have the loan, it even heard on the recordings by the FOS.
You are entited to request for copies of your loan papers and agreements etc, but they may only send these if you request a SAR which is known as a Subject Access Request where all the information they have on you is sent to you by 40 days they have to do this.
However there is a payment of £10 cheque or postal order for this, I will post the template in another post below not to confuse things here.
Was it Nemo that actually arranged and sold you the loan?
You need to write to the ones who arranged this for you, but Nemo should be able to supply the documents for you anyway.
If you've no agreements for this, you can request these but I think there may be a charge of a £1 for this, check first hun and always request for anything in writing and post by recorded delivery for your proof of posting and to check on the time scales they have.
For now check this link out here for more information on PPI, there is also a template letter you can use to help you but add your own reasons, and as much as you can to support your complaint.
They have 8 weeks to respond, take if from there hun and let us know what they say so we can help you to the following step if required.;)

Good luck and in the below post I will add the template for the information you require, do not send in the same envelope, send separate to the reclaim complaint letter so that they do not get the letters muddled for timescale reasons.

As promised here is the SAR template to request for all your info, remember to enclose the £10 cheque or postal order payment, if the PPI was in anyone elses name and not yours, it will be best to ask for the request in their name, some request for 2 payments of £10 for both even though its the same joint loan you can always check by asking them first if you want to.;)
SAR - SUBJECT ACCESS REQUEST
Dear
Re: Account number:
In the first part under the Data Protection Act 1998:
Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.
Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
For the avoidance of any and all doubt, I reiterate:
I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).
If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).
Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.
I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.
I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.
You have 40 days in which to comply with this request.
This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

You now have a few choices. You can seek the premium back from Nemo regarding mis-selling or, depending on the circumstaces surrounding you getting the loan in the first place, you might challenge the loan itself. The latter is a bit more complex and is likely to require the aid of the legal profession. You are likely to get far more back via the legal route but it really depends on what you want to do.I am a former Broker, former IFA and former compliance officer, for my sins.
However, I have since seen the light.0 -

hi margetta ere cud i ring them and ask for a refund that way before writing a letter thanks:j:confused:
I would keep everything in writing hun and keep a copy, as they have 8 weeks to respond in full, if they did not get back to you by the 8 weeks they are entitled to, you have this as proof then for the FOS if it went as far as them, post by recorded delivery.
There is a template on that link I added earlier.;)
If they do respond and this did not go in your favour, you can still take to the financial ombudsman service for them to investigate. xxThe one and only "Dizzy Di"0 -
