  • So if your lender came round and said we'd like to do the house up at our expense ship you off to live somewhere else for a month at no cost to you then when it comes to you moving back in your lender said' we have had an offer by someone that will pay more per month on the loan' how would you react?

    Sounds like you are the sort of person who should work as an MP or for your local council.

    So if your lender came round and said we'd like to do the house up at our expense ship you off to live somewhere else for a month at no cost to you then when it comes to you moving back in your lender said' we have had an offer by someone that will pay more per month on the loan' how would you react?

    In my view you have to let the tenants return at the same rent, unless the agreed previously to a higher rate. Although if they were awkward in the first place then it might have been better to serve notice on them and start afresh to avoid complications.

    It is difficult to perform on-going maintenance with tenants in situ but things need to be done to keep on top on properties before they get out of hand, so I'd say that the refurb was the right thing to do, after all you need to protect your property at the end of the day, but I'm not entirely sure that you have planned it all in the best possible way.

    Luckily for us we have to vote them in, Pickles110564 is to busy to be an MP at the moment as he's saving the docks .

    That would seem to be the most logical way of doing things but the OP is not logical nor is he truthful. I would suggest that this is a wish-fulfillment fantasy by a sad little man who yearns for power in the real world so tries to create the impression of it on here.
  • Three issues to ponder on this.

    Legal issue:
    Can the OP do this?
    It depends on the tenants contract I assume. I am not legal expert so I can not make any comment myself.

    Moral issue: (I believe this is the main concern of the OP)
    I have to give kudos to pickles for bringing this in to a forum. Others could simply go ahead with this (given that the contract allows it) without a thought.
    The morality of it again is depending on the circumstances.
    For example my LL had a property let to an old lady.
    Not sure what the tenancy agreement was called however it was one of those that the LL could not evict nor ask the tenant for rent increase.
    The lady died few years back and the son claimed that he has inherited the agreement from his old mother.
    This man lives now in three bed house with a monthly rent of £70.
    In this case the tenant is exploiting the LL and any LL would have been morally right to do what pickles thinking of doing.
    Pickles really have to ask himself if his tenant paid him a fair rent before he made him move.

    Financial issues:
    Is it making business sense risking lose your tenant?
    My LL is worth his weight in gold. He is keep the property well maintained and charge me significantly less rent to what I would have pay for similar properties.
    When he asked for rent increase it was only moderate.
    However, I as a tenant, worth my weight in gold as well.
    In the last nine years that I live in this property I never delayed the rent nor did I damage anything besides normal wear and tear. When I have some painting done I always ask my LL approval on the colour (and he always had provided me with the paint).
    I am lucky that I have cheap rent and also my LL is lucky that he had neither voids nor damage in his property for the last nine years.
    In some other of his properties he had to spend thousands to redecorate after each tenant left.
    In other cases he had tenants that not only damage his property badly but also left significant rent, counsel tax and utility arrears when he eventually manage to evict them.
    In this issue again pickles have to ask himself if his tenant is creditworthy. Did his tenant look after the property?
    If yes, then does really worth the risk, for few extra quid to get rid of a good tenant for someone which he doesn’t know and may (or may not?) be a LL worst nightmare?
