Am i entitled to a refund?

I bought a mamas and papas luna pushchair from a local baby store 10 weeks ago. This week the harness has snapped which has made it un-useable. The raincover has also broken after being used just once!
I went in this morniing and they said that they will get a replacment seat unit and raincover from the manufacturer. I explained that i wanted a refund as i now did not trust this pushchair to which they replied that i am not entitled to a refund. Is this true?
They said they would only give a refund if something went wrong within 28 days.

I think under the sale of goods act the shop are acting correctly in offering to replace or repair or you could ask for a refund but they are entitled to reduce this amount depending on how long you have had the item for fair wear and tear etc. As you have had the pushchair for 10 weeks I don't think you could expect a full refund. You might like to check out your rights with consumer direct though just to be certain.0

I suppose it depends on how generous they want to be.
Years ago I bought a buggy for DD from Children's World (yes, THAT long ago! lol), it should have come with a matching cosytoes and cover but didnt so CW promised to order it in specially. 9 months later, and a lot of chasing I still had no coseytoes or cover for the pushchair. CW admitted defeat, told me to come into store and choose a brand new pushchair £50 over the value I had originally paid.
I was stunned at that! DD had a beautiful new buggy and eveyone was happy.0 -
Once you've accepted the goods it's up to the retailer as to how they sort this out ie their choice on a refund/replacement/repair I'm afraid. If it happens again you might have stronger grounds to request a refund.0

I'm not sure the refund should be ruled out. If the safety harness broke it is not fit for purpose as well as faulty. It might be worth looking specifically at whether it is advertised as up to a certain weight or child age, as that gives and indication of how long they claim it will last. I would contact trading standards for advice, you might find that the store backs down more quickly.
That's really poor though. I had a moses basket from mama's and papas and the mattress curled up round the edges after 6 weeks making it unsafe as the blankets couldn't be secured. I went into the store and mentioned it and received a shrug and 'no-one else has complained'. Suffice to say now I'm looking to replace my buggy I won't be going there!For everything else, there's MSE :T0
