Financial Hardship - HELP PLEASE!!

Hi im fairly new to this site - how fab is it!!
Please could someone help me....I put in a claim for my bank charges last year and it is currently on hold like everyone elses!
I had a baby in October 2008 so im currently on maternity leave earning £117 per week! Does this allow me to qualify for financial hardship?
As a couple our monthly outgoings are £2000 and that doesnt include food. My partner earns only £1200 and even with my maternity pay we are just under the £2000 mark.
If I do qualify, please could someone post me a template letter?
I understand my bank (HSBC) will probably send me a form to fill in to show my monthly outgoings, do I complete this as a couple or just myself? E.g do I just put down MY SHARE of the bills etc (£1000) or do I fill it out showing my partners income?
Does anyone know if HSBC are paying out for hardhip and how quickly?
My bank wont give me an overdraft and im currentl in the red at the moment so no doubt that means more charges
Do I send an up to date list of charges and interest up to todays date?

You have to complete both incomes as I am sure he contributes towards them. You need an up to date list if there have been further charges since the first claim. Did you get to court stage or was it just with the bank?princess007 wrote: »Hi im fairly new to this site - how fab is it!!

I just checked and I started the claim in March 2007 so its almost 2 years! I got the court stage and a week before my hearing it was stayed! :mad:
Shall I ring HSBC about this or send a letter? What do I say??0 -
I wonder if someone can help. due to unemployment I was dealing with someone in the hardship deprtment who was dealing with my claim, they agreed to pay my rent arrears if I supplied the infomation to prove im in arrears.
Problem is I sent this before xmas and have been trying to cntact them to make sure they have recieved it, unfortunately I lost the letter with the number on it and the various numbers I have found just get me to Manila or India and because my account is now closed and with Metropolitin collections that is the only infomation they tell me.
Its very annoying, I think the people I spoke to were in Leeds, does anyone have this number??0 -
As you are court stage, I am afraid you can only ask HSBC about charges not subject to court action and for them to look at them. The ones at court stage will have to await the final decision of the OFT test case, I am afraid.princess007 wrote: »Thanks for replying.

HSBC are in breach of the FSA Waiver and I would make a complaint to the Financial Ombudsman Service and explain the details. DO NOT AGREE ANYTHING WITH MCS. Tell them that the account is disputed and that HSBC have sold the debt to them in error and that you will be making a complaint to the FOS over the matter.0
