Hi, not really sure where this should go but this forum seemed like the best place to start!
Just before Christmas I bought a phone off eBay, on the listing it clearly states that the phone includes a warranty. When the phone arrived there were no papers to do with any warranty so I emailed the seller via eBay, who responded saying:
"Our warranty is our after-sale service(our promise no paper),is there is any problem, according to the Item No your ID,we know that you are our customer and we will resolve the problem for you !So,don't worry about it"
Now to my understanding, that's not what a warranty is, so I thought I'd go look on Wikipedia, here or Dictionary.com to find exactly what it meant, but all they say is that it is a promise, so instead I wrote back asking how long the warranty covered the phone and what it covered, they replied:
"The warranty for the phone is one year,if it lost,I will send the replaement,if it is defective,I could offer exchange, the battery is also warranty. Thanks"
Since receiving this reply, I've been back to the listing and had a good proper read and it says this:
"Return Policy:
Also, if I have it in the writing from them that if lost a replacement will be sent, are they legally obliged to do so if I lose it within the six months?
Thanks in advance! I knew I shouldn't have bought a phone via eBay from China..

"Return Policy:
- Six-months warranty.
- DOA(defect on arrival): All claims for DOA( defect on arrival) must be made within the first 7 days of arrival.
- Returns: We stand behind every product we sell. If you're not pleased with your purchase, please kindly contact our customer service representatives via email or ebay message for an authorized RMA number. Your returned product(s) will not be processed without a RMA.
- Buyer is responsible for return costs. Shipping and handling fees are not refundable.
- We do not accept the returns repairing or checking by buyer’s side without our authorization."

Also, if I have it in the writing from them that if lost a replacement will be sent, are they legally obliged to do so if I lose it within the six months?

thats the sellers warranty/terms not an official one from the company. if u wanted to claim off the company of the fone u would need an original receipt and isnt there a 'distant selling/second hand' clause nowadays saying if resold the warranty is void?!0

That would be lost in the post.
Do you know any retailer who would send you a new one if you managed to lose what ever it was you had brought?"Love you Dave Brooker! x"

How are you any more protected if you have some piece of paper that the seller has scrawled in crayon Warranty?
All a warranty is, is a promise to fix defective items it doesn't matter if this is written on paper, stone or cast in gold as long as you can prove it was part of the terms when you bought this phone.
Looking at the language etc I wouldn't hold out much hope though if anything does go wrong - surely what the warranty entails etc are questions you should have asked before buying?0
