Parking ticket - Coventry

I park in a council pay and display car park for work, on December 5 I received a ticket through the post saying I failed to display a ticket. Aparently on october 31 I failed to display a ticket.

Having never cleared my car out i went and in the footwell of the passenger seat is the ticket clearly showing that on 31 Oct I paid £2.00 (its £2 all day parking). So I fill in the apeal form stating that I had paid for a ticket, displayed it and sent a photocopy of the ticket as proof.

This apeal was rejected, and after reading this site I realise that this is pretty much normal.

However I have been sent photos of my car (an old espace) and a few things concern me.

1/ there is a ticket on the window, which wasnt there when I returned, ok some clown could have taken it off.

2/ I drive an espace, and for those who do not know there are four windows down the side of the car, one thats effectively the boot, the rear passengers, the drivers and a small trianglur one infront of the drivers window. (this is the window I stick the ticket too). The photos of the car show the window screen, the rear window and the two back windows, not the drivers side window or the triangular window.

My partner also pointed out that the angle the photo from the front is taken the ticket blocks the pay and display ticket

However I do have my concerns:-

1/ Is it my paranoia or is it a bit conveinient that the window the ticket was displayed in was not photographed?

2/ The only evidence I have is the pay and display ticket (timed way before the ticket time) will this be enough?

3/ Although the car park is owned by the council, the sites are run by a private company called CV-One, would this count as a civil or criminal ticket?

4/ As I said I received the ticket through the post, but the photos show one on the car, is this therefore classed as a posted ticket?

Sorry if ive bored you but I woudl really apreciate any advice you could give me. Its just I dont think it is fair I have been given a ticket when I have paid, parked in the bay and know for definate the ticket was displayed (it blocks my wing mirror so I always note when I have to take it off).

    It's not very clear whether this is a Council PCN or not?

    If it is then I can tell you that Coventry PCNs are absolute rubbish and possibly the worst in the country.

    When scanned (absolutely everything!!!!) then don't edit that post cos forum won't show you have responded. Just add a new reply so I notice it.

  • On the council car park tickets for my local council, it clearly states to attach the ticket to the windscreen.

    Its a council car park, but the council allow a private company called CV-One to run its buildings and car parks, They collect the rent and issue the tickets, so im not 100% sure if its a council ticket or a private one.

    Hopefully will get it scanned in a doy or two.

    How do you mean by rubbish?

    I had this at Hammersmith Hospital in London. I had a ppay and display ticket on my dashboard, yet the Patrol woman gave me a ticket - she said I had not stuck it to the window! (she was still there)
    Luckily, there was a witness, and I took their details, the parking attendants details, copied the ticket and wrote to the parking people. They first said the attendant stated the ticket was not clearly visible, as it was raining!!!!
    They did agree though, I was in possession of a valid parking permit, and waived the ticket - on this occassion. (I should never have got it in the first place)

    Apparently they don't issue the tickets. The Council do so it is almost certainly decriminalised under CPE.

    Rubbish? - They fail to comply with the requirements of the law - by miles!

    On the ones they were using a few months ago about all they got right was their name!!!!! LOL
    Since 'improved' - but - well err, if you can call it that!

  • Neil B knows his stuff so along with the PCN angle, I recommend getting the Parking Dept to provide a copy of the CEO's log book.

    If they failed to to record that they checked all windows (usually abbreviated in the book to C/A/W) and without photos of all windows they cannot be conclusive that you failed to display a valid ticket. The fact that you are able to produce a valid ticket would mean that they do not really have a leg to stand on at adjudication.
