Ebay problem with seller.

I have bid and won a pair of shoes. The seller dispatched and the arrived in good time almost as described. The main problem being they are not a pair. The are the same style and size, however there are obvious defferences between the two shoes.
The seller is stating they will refund as a good will guesture under their terms ie no refund of postage.
Should I expect more and open as not as described with paypal?

If you return under a dispute, they will have to refund you postage, although cost of return will be down to you.
Go to Paypal (assuming you paid with that) and open a "significantly not as described" dispute.
I'm assuming that the seller said that they were a pair in their listing.0 -
Email the seller and tell them that you will open a "significantly not described dispute" with Paypal unless you can achieve a mutually agreeable outcome.
99% of the time you will find that most spurious sellers agree to this as, if Paypal finds in your favour and it seems that they would be likely to do so, their Paypal account is restricted from use until a refund etc is paid. Also they will want to avoid the negative feedback.

Well the seller is sticking to his guns and stating no postage refund unless I leave him postive feedback first.
I have now opened a dispute with paypal, what I want to know is, to assist my claim is there anyway in which I can add photos to the dispute page?Hi, we’ve had to remove your signature. I'd leave a neg for any seller that made me go to a dispute for a refund. Also stating no postage refund before pos feedback would earn them a neg too.
Other buyers need warning about sellers like this.:heart2: Love isn't finding someone you can live with. It's finding someone you can't live without :heart2:0 -
Wait until you get your refund, then leave a big fat negative for them!
Can you post a photo of the shoes so we can see the difference?

If you have proof of the feedback comment put that in the dispute. I am sure that feedback blackmail is against the rules.
You could use something like imageshack and put the link in the dispute.

I had this with a pair of shoes which were many sizes smaller than described in the auction. The seller said they would refund once I returned them. I did return them, but stupidly by 2nd class post. The seller then denied ever receiving them, and offered me, as a 'Goodwill gesture' a refund of 99p denying that they had ever offered me a full refund. I went down the Paypal route, and because I couldn't prove that I had posted them by trackable means, I lost.
However, I would definately open a dispute with Paypal which I am sure you will win. Just please ensure that you return by recorded post, (which unfortunately I don't think is refunded). I have won at other times when items have not been as described and I have returned by trackable means.
It often isn't the money, it becomes the principal when E-bay sellers are dishonest. Whatever you do, don't leave positive feedback and DEFINITELY report to E-bay for blackmailing you. It is against their rules and they will be investigated!
