THIS IS ALSO ON THE CREDIT CARD SECTION SO PLEASE DO NOT GET MIXED UP THANKYOU
I have two credit cards, and i'm currently unemployed
I have accumulated charges on both accounts recently and started a dispute, however this has made the credit card companies wish to default my accounts and close them down.
capital one card(limit 1000) balance 1250 approx
egg (limit 500) balance 606.88 morcroft(or some agency) egg say 607.88, why they think the amount is a pound difference is not apparent.
I have access to a limited amount of cash funds later today to make the min payments they wish me to make or pay as much as I can afford.
My main question is though the charges (i know i will be able to argue them successfully) make up a fair amout, but only 80 pounds with egg. Would I be better off saying I have no intention of keeping either accounts and have only a limited amount of money, then to explain they can take me to court and recover the debt - this resulting in the bailiffs, but I will be stating that I own nothing they can take.
Would the card companies be willing to settle the debt for say 25p in the pound ? this will be saving them hassle and they will be cutting there loss's.
The other option is to pay them back in full by borrowing at 0% of a friend, then taking the said companies to court to recover the charges ?
If anyone needs further info to give advice let me know, also if you think you have the best plan of action for me to take fire away.
many thanks in advance.

No idea, but you're not allowed to poast the same thing on two boards, so one of them will get locked by the mods.
Maybe go and delete the other one as this is the best board for you to be on.:cool: DFW Nerd Club member 023...DFD 9.2.2007 :cool::heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

if the accounts have been defaulted recently then you have no chance of getting a settlement offer of 25p in the pound, with both of these creditors and their respective DCA’s the very least they will normally accept is 60p - 70p in the pound, and this is normally after 4-5 years of the account being in default.
you best solution is to write them outing the charges you feel to be unfair and making a settlement offer which excludes those charges.
they will more than likely settle for this rather than continue to chase you:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0 -

One question: to do with you situation - how long have you been unable to pay the creditors? A timescale of the situation may help.
One comment: I've been surfing the net for a long time. This is probably the best place for advice about debt for anyone living in the UK. It may be up 24/7 but not everyone sits here reading it 24/7. There are a lot of good people who may be willing to help you, who will look in later. Then again, with a comment like yours, I can understand why they might not.A house isn't a home without a cat.

I have writer's block - I can't begin to tell you about it.
You told me again you preferred handsome men but for me you would make an exception.

People on here are lots of help - but you need to provide all the info and have some patience. Not everyone is on the boards all the times, as said by Bob Property. DFW Nerd Club member 023...DFD 9.2.2007 :heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

Hi Russell,
Judging by your above comment I wonder did the CC company impose the charges because you have an ungrateful / bad attitude. ???..(just a joke my friend)
My advice would be try to negotiate a amicable solution with the CC cards.
You say you are disputing charges with them, if they have wrongly imposed penalties on you hopefully you will be able to prove this and they will accept it.
To allow it to go to court / baliffs or for you to try and take them to court. Is it worth the grief / hassle ??????
If you don't pay the original debt do you really want those defaults on your credit record, debt collectors etc etc.
Maybe you can tell us what charges were imposed for (ie what reason the CC gave for imposing them ) and why you are disputing them ?
In regard to your comment "damm people on here are not much help".......................how many posts giving positive support /advice to other members have YOU made ???????????
Maybe look at some of the other threads on this page and see all the endless advice and support people give to other people.
This site shows the best side of humanity so think twice my friend before you cuss all the decent people on here.0 -
Going to court will not mean bailifs. In short, you go to court and the court orders you to pay an amount you can afford and, in your circumstances, will freeze interest and charges. In fact you want to go to court.
Go through the other threads and read up on this. Send the companies you owe money to details of your income and expenditure and offer to pay a few pounds a month. Whether they accept or not start sending the amount you offered.

well contacted egg today, they caved in/or the agency egg had used did straight away when I asked them to dig up a letter I had sent them.
I said can you let settle my dispute first, they stated clearly any of eggs problems were now their's (moorcroft), with this I stated that I would have to issue summons against them now ?, with this the member of staff asked what for ?..... I stated for reasons outlined in the said letter, then I was asked how much, I stated 80 pounds. Was told to hold while they queried their manager.... the reply was "we can settle for xxx amount", the amount was less than the total balance minus the 80 I was going to contest them for so with this I got the debit card out.
Thing is how far as these agencies allowed to go ? Egg sold it to them, but for how much ?
Was hoping to get some court practice in before the posibilities of the high street bank and othe organization i'm now taking on going to court.
Thanks for you advice, but for me this has become a enjoyable past time, moaning and arguing0 -

Whew! Thanks Xbigman for clarifying that. Was reading this thread and got cold chills when reading about the possibility of bailiffs from Russe11:

Is that a joke, would be more than happy to contest any case in court if I thought I had any remote chance of success.
As far as I can make out, they only go to the expense of the bailiffs if they know they have something they can take.
Its seems to help to tell them you are prepared to pay up on threats, as often there intentions to do much is more costly when you have no means of paying.0
