Industrial Injuries Disablement Benefit help

Hello all
Back in October my husband foot was run over at work by a forklift truck which has resulted in every bone in foot inc his heel being crushed (except his toes due to his work boots protecting them).
After being in hospital and after having operations they have done all they can and he is unable to walk on it all due to it being so painful and completely flat and out of shape / bent. His ankle / leg is also seriously bent too.
We are gutted as he is only 32yrs old and is a very active person and we do a lot of physical stuff with our children which the surgeon has said my husband will no longer be able top do.
He takes pain killers several times a day. He will have to wear specially made for him shoes for the rest of his life and the surgeon has told him he will never walk with out help of a crutch again and it will always hurt as some fractures wont now mend (this is at best we didnt ask what the worse would be).
I have to do everything for him still as he is unable to physically get in a bath so i am helping washing him. We have set up a bed in the front room as he cannot go up stairs (we have a loo downstairs thank goodness). He cannot carry anything as he has to use crutches or he falls as the bad leg seems to be several inches than the well leg too!
As he is unable to work at the mo (not sure if he will be able to do his previous job tho as it involved a lot of walking) until his starts physio to try get his muscles working back in his leg as he hasnt been able to walk since October we have put a claim in for
Industrial injuries disablement benefit.
They are sending a doctor to our home to assess how disabled he is with ref to the claim on a scale of 1 to 100%.
Our questions are
Has anyone else claimed this and what does the doctor assesment involve?
Also will my husband be classed as disabled and who judges that? Do we have a bit of paper saying so from someone official if you like?
Thanks for any help or advice. We havent a clue what we should be claiming or doing and at the moment are still being paid by his employers but i am sure there will be a time when they wont if he is not going back to work shortly.

My friend had an industrial injuries claim.She said the medical was just a straight forward medical examination.They grade you as being disabled on a percentage system for a set length of time and there are set payments depending on the percentage of disability.The notes are passed on to a decision maker to decide.
I don't think you are automatically classed as disabled,she went onto get DLA,which entitled her to a blue badge ect. but someone may be able to tell you otherwise.
She gets the industrial injuries benefit even though she works.It's payable no matter what she earns.
She has a letter stating her percentage of disablement,for how long the award is for and for how much and what her disabilement is.0 -
yea i agree with mrslittlemouse of above ,I had a bad accident at work with turned in to many things over a few years, i have got IIB but what a job , went to see there doctor , was only in there 15 mins... small chat, had people knocking door to talk to him , did a small balance test , i fell on top of his desk, then he gave up . got turned down , went to appeal , had small medical with them in separate room , lost balance again ,he gave up , and won the lowest rate ! :T for 4 years , then it all starts again , but lost about 95 % of it, as on benefits , they take back most of it , so for a year's fight :mad:, not worth it really for all the stress and time seeing consultant orthopaedic surgeon 's for reports ect .... but hey it's extra few pounds i did'nt have
by the way they don't class you as disabled, as you have just had an accicdent . I am registered disabled as i am deaf . but not as i have had bad accident . i think you have to lose a sence ( hearing -sight ) or limb to get registered , i have a social worker that did the register bit for me .at medical just tell everything and be honest , as they check out with doc and hospital , me doc and hospital reports are about 2 inch's high i throught i would have got in , but got turned down , but won on appeal , so it don't win go appeal ,ask CAB to help or local disability people help DIAL ect, as they are on your side they know how to fill out forms and can be a tribunal with you , and speak for you , then more evident the better it is , i wish you good luck as i was scared to death at mine, but they where the nicest people ever , who took time to listen and ask good questions i could understand .

There's no such thing as being registered disabled any more. Simply an entitlement to DLA at the present time, which can be made permanent I understand.
I don't know if Ind accident benefit and DLA can both be claimed at the same time, but DLA isn't means tested or reduced if you work;)I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

i get ind benefit plus DLA together so yes you canthe truth is out there ... on these pages !!0
