ichorus it sounds like you had the same guy who I spoke to. He was a complete pillock and had no idea what he was talking about.
Your SOA is basically your budget with monthly income and outgoings also called your financial statement. There is a sticky at the top of the forum with a link that will help you fill one out.

Yes I paid with a Debit card, I'm receiving a new one in a day or two anyways. So hopefully they dont take all my money between now and Monday. They said the account would be on hold for 14 days, so hopefully they stick by that.
The account was a credit card.
Limit £1000.
of which the details escape me. Just Basic credit, I did have insurance on it, if I lost my job. Which I did lose it. and the refused the insurance claim.
It went slightly over like £40ish because of missed payments and they closed it right away.
They then asked for payments via My lloyds tsb current account.
Which i agreed to obviously, but they instead sent me bills saying that it was a £40 charge and that I needed to make a payment plan. So I phoned and made it clear that I was paying them £40 a month. They accepted and carried on taking £40 a month and it went quiet for a while until the amount with interest ended up at £1500. Thats when a Collections agency contacted me saying they would make it £1000 again if I paid then or agreed a payment plan. I replied with a letter asking to make £40 payments. This has happened a few times and it gets passed on without a second warning or accepting the payment plan. Now its at Apex and the total is £2000. They said If I could pay now they would make it £1500. Which would be great to do, but I cant really do anything now that I'm redundant. So I said £30 per month for a 3month period and then change if I have a Job. Now they said they will see what my in and out goings are like and will let me know how much they will be willing to take. He said they might or might not accept £30 even if that is all i can pay.
Fun and games.
When i send my letter of what I'm getting from JSA and my out goings is there anything i can do or say that might help them accept £30 a month?
Also would it be best for me to have control and pay via direct debit or standing order rather than give them access to my card again.

Under the OFT guidelines they cannot refuse a reasonable offer of payment so unless you are offering them a silly amount less than what you can pay they have to accept it.
I reminded them of this when I wrote also pointed out that my other creditors had accepted my financial statement and that Halifax had previously accepted the amount I had offered them. It worked OK.
Make sure you pay the debt by Standing Order that way you have complete control and they can't get anything more than you send them. Do not get a direct debit because they can alter this when they want. Personally I've not had any problems with them taking payments off my card if I haven't authorized it. I'm pretty sure doing this is illegal. Then you can reclaim all the insurance payment you made as it was evidently mis-sold.

Reclaim all the charges that they added to the acount.
So I phoned and made it clear that I was paying them £40 a month. They accepted and carried on taking £40 a month and it went quiet for a while until the amount with interest ended up at £1500.
You cannot reclaim interest but you can charge 8% interest on any insurance or other charges you reclaim.

If you are on benefits, you really should only be paying £1 a month.

If you pay by DD, they have control of the payments, so you need to set up a standing order.

Thanks very much folks. Alot of Help. I will get on with sorting this out.
I know that I can go to £1 but I'd rather pay the most I can until I have a Job again.
One last thing, if I was to claim back Insurance and Charges, would it be best Via Apex, or is there a way I can Bypass them and speak to Lloyds direct to sort the whole mess? Charges and Payment plan or will Lloyds tell me to deal with the Apex?0 -
recharges are via LLoyds as they applied them. They will just organise to reduce your debt , but that is fine.If you've have not made a mistake, you've made nothing0

Hi, Today I received a letter from Apex aswell.
They have said this is final chance and so on.
I was going to phone them but I have another debt of similar amount and only talk Via email and Letters (email if there is a problem needing s quick responce) and have found this to be the best way.
Just to sneak in here...but what is their email address? I have written to them several times with a payment plan but have had no response. I have also written to them to ask them to stop phoning me, but they still do. It would be great to email them to if possible. TIA0
