Have you heard of Apex management ?

im really sad, Halifax have sold my credit card debt to a company called Apex - I have called them this morning I owe just under 2k - I asked what I can do or if I can make an arrangement and they said no. If I dont pay the full balance by the end of the month the debt collector will be at the door and take my stuff - can they do this ???? feels like im in a gangster film and the heavys are being sent :mad: :mad: :mad:

Don't make any more phone calls! A less reputable debt collection firm will threaten you with anything and everything to frighten you into paying - they won't dare do the same in writing as it's illegal. Use one of the template letters on the stickys on the main DFW page to ask for all communication to be in writing, a copy of your credit agreement and balance. Send your letter recorded delivery.
Unless this documentation is provided within a certain timeframe the debt collectors cannot take any further action. If they do provide it you can then make a proper written offer to pay in installments. If they ring you, refuse to answer any security questions and state again that you want all communication in writing.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
Apex are the DCA for Halifax credit cards, and yes they have taken over your debt.
However, they cannot send debt collectors without first going to court and getting a county court judgement, they are some way from that.
You can negotiate a repayment plan or seek to find out if they have a CCA - I deal with Apex through my DMP and they accepted my repayment plan.
The important thing is not to be intimidated by these people.Unsecured debt 2008 c £45,000

Debt Management Plan
I've been with Payplan for 2 years and they have been great, if you owe to debt collectin agencies I would recommend professional help from these or CCCAUnsecured debt 2008 c £45,000

I noticed this thread as my partner has just had his overdraft sent to Apex...they ring 5-10 times a day..we have never answered it though. We have written to them with a payment plan, just waiting to hear back.
Can I ask though...I can't see the sticky with the template letters on in debt free wannabe...sorry if Im being blind, do you have the link?0 -

The template letters for CCAs will not help as bank accounts are not covered by the CCA.

Hi, Today I received a letter from Apex aswell.
They have said this is final chance and so on.
I was going to phone them but I have another debt of similar amount and only talk Via email and Letters (email if there is a problem needing s quick responce) and have found this to be the best way.
I have sent them an email and a letter saying that I want to pay and that only 4 weeks ago there was a different Credit Management Team contacting me for payment and that I had contacted them to start paying and got no reply from them.
This has happened since I got into the debt to be honest, I agreed with lloyds to pay £40 a month from my account with them, instead they took it as a charge each month , and didnt decrease what I owed them.
Then I got a letter from a debt collector saying that Lloyds wanted to half the amount owed. (because it was originally £1000, they charged until it reached £2000) So again replied saying I wanted to pay £40 a month and more when I could. Got no reply. So now I get the feeling from this letter that it might stop here.
Hopefully i get a reply from them, because my credit rating has returned almost to normal. :j0 -
I found Apex to be impossible to talk to over the phone they won't negotiate anything and put unreasonable demands on you. I wrote to them and gave my full SAO. If you have a previous agreement with Halifax to pay the card offer them the same and point out that this was already accepted by the bank as a reasonable payment. Pointing this out will really help your argument. what a SAO?
Is that outgoings?
I phoned them just to see what would happen. 1st thing I said to them was I was redundant from Jan30th,
Then he said so how much did you earn. So i said it was £700 a month but my last payment was £500 on Feb 6th. So he calculated my outgoings to £430 and said he would not accept £30 per month, and that they would only accept £270.
I then reminded him I am out of work....
So, after him yelling down the phone saying that I lied to him about how much I earn, even though i cleary stated that I am redundant and that he asked for what i used to earn, he then said "so as you said your not getting benefit right now?"
I said no, it will be a couple of weeks before i receive it, he then said that I was lying again saying he asked me "Are you on benefits or waiting on any" He only actually asked "Are you on Benefits right now and able to make payment" to which anyones answer would be NO, when you cant pay.
So argued more until he said when you get JSA contact us via letter with all your details (which apparently he said that I couldnt do via letter when i first spoke to him) and we will either accept or refuse £30 a month. So yeah a letter will be sent soon. Oh and he took £30 today to "hold the account for 14 days" after him saying it would hold for a month.
He kept contradicting himself and forgetting what he said. I enjoyed pointing it out to him. I'm usually really scared of talking on the phone.
Dont give in when you phone, remember exactly what you say. They spout off so much rubbish to bamboozle you and you will get the better of them if you can keep yourself calm.
It is a shame to go from one nice collection company (sterling park)
to Apex, who attack you. Apex had the nicer letter though, so yeah letters always folks.;):rolleyes::D0 -

First off please never make the mitake of ring ing a DCA ever again. It is not a good idea as they will bully you and you have not record of the transaction or the breeeches of OFT guidelines that they often indilge on the phone but dare not put on paper.
Secondly, did you give them your debti or credit card number? If so, please cancel that card as there is nothing to stop them taking more payments when they want to and you will struggle to get the money back.
You do not say what sort of account this is for and when you took it out?
Did you have PPI on it and have you started reclaiming the charges yet?If you've have not made a mistake, you've made nothing0
