AND THE CHASING BEGINS!!! Received an email from one of my creditors (Jacamo) advising debt collectors are now chasing payments on their behalf. Checked my DRO the debt is definitely on there, so I sent them back a nice snotty email. I did advise all my creditors by letter myself and they will have received notification from the official receiver. So why would they still be in contact? Do they try it on to see if you will still make payment? Anyway told them where to go and advised them of my DRO reference number and told them that if they contact me again, I'll be on to the official receiver. I take it some companies still need a kick up the backside.
Anyway, was great checking my new bank account when I got paid last week and to actually see a bank balance was a great relief!0 -

During the 12 month moratorium the creditors still exist, just in case the DRO is ever revoked, and therefore they are allowed to pass the debts on to collection agencies/solicitors firms and add on interest and charges onto the balances, which they will then write to you to confirm, which they are allowed to do.
They cannot ask you for payments, send anybod to your property or take court action against you.0 -

Got a nice letter yesterday from the debt collection company that jacamo are chasing payments from me with threatening court action. I phoned them this morning and they are obviously just trying it on as they are saying they haven't been advised of my DRO when they would have been advised by the official receiver and I wrote a letter to them myself. Anyway as far as I am aware, I can forward onto them my forms that I received advising of my acceptance for the DRO, so I will scan them and email them over today.0 -

With this in mind, is it worth sending letters recorded delivery?0 -

I did originally also email all of them, but that was too the customer services email address. They also stated that they didn't receive confirmation from the official receiver, who would have also sent confirmation. So that will have been 3 lots of confirmation all creditors would have received. It's a coincidence that of the 7/8 creditors only one have stated they received nothing, which is why I have come to the conclusion, they are trying it on. Anyway, I have sent them my confirmation forms to a direct email address they supplied me with, so hopefully now that will be the situation resolved. If not, I will contact the official receiver.0 -

Yes it is lol! Anyway, I emailed them with confirmation of my DRO, got a response advising that they updated my records to reflect my DRO and WHOOOSH!!!! The next day they sent a letter threatening me with debt collectors. Ah well they did say ignore any further correspondence so hopefully that will be the last time I hear from them!0 -
hi again.
creation have been on the on the phone asking for payment when the dro has been accepted.
we gave them the number of the order and they said they'd check the insolvency site which they did and my wifes name was on the website.
they said because under the court it says not applicable to a debt relief order they're saying they can still ask for money
we have the letter saying it has been accepted and Moratorium Period will end on 03 January 2015.Live each day as if its your last0 -
They are either very stupid or are trying it on.
They are bound by the DRO whether they like it or not and are not allowed to demand payment. One of the major points of a DRO is that it is a binding form of insolvency that is not required to go through the court. The law allows this and prohibits creditors from having any remedy against the debt.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
