Capital one problems any help please

Hi there

I have a cedit card with capital one and am having difficulty paying back due to hours being cut at work i have tried to speak to them about it but they keep saying they will send a self help pack out to me which i havent recieved now they say it is too late as the time has gone for me to be able to do that.

Also i have questioned some transactions they have told me about that have made me go overdrawn by what they call a small amount which mounts up to around £300 but i know i didnt use the card in that month due to work problems but they say they cant disscuss it with me (but it is my account i said ) but still they cant discuss it with me i dont ever remember the aggrement saying i can go overdrawn oherwise i wouldnt have signed it (Oh and they wont send me a copy of the signed aggrement that states i can go overdrawn by the way) because otherwise whats the point of having a credit limit or is it they just let you go overdrawn when it suits them to make more money.

Any help will be gladly recieved

  • I had tremendous difficulties with Capital One some years ago....I found them quite aggressive and unsympathetic in their manner. In the end and because of their behaviour, I sought advice from Citizen's Advice who were a great help in the matter. And so the only advice I could offer that I know from experience can help, is to give CAB a ring.....I am sure it will help save a few headaches!
  • I have been to the cab and they have just said they will contact them and come to an arrangment but i am trying to find out if they are breaking the law by not disscussing my account with me and and letting me go overdrawn as i dont see the point of a credit limit but still they are not willing to disscuss with me also all the charges that are now getting put on my account im not sure if they are justified. I am getting nowhere with them and i am just really getting stressed with the whole situation so if anyone else has any info or advise it would be graetly recieved

  • It might be worth giving them a call to get the name of the person who deals with complaints and then making an official complaint in writing (keep a copy) and see what happens. You could also check out the Office of Fair Trading website as I believe that, under the Consumer Credit Act, you are entitled to receive a copy of the agreement if you pay £1. You could also make a complaint to the OFT as they issue the credit companies with their licences.

    From my experience there is some form of 'additional' limit on my Capital One account which has proved useful when I've made purchases that just push my limit over. It is rather handy and I didn't get charged that month but they do charge £12 after 2 months have passed and your still over.

    I don't think it's a bad idea.

    I'm slightly confused as to why your disputing a transaction which has taken you over your limit. Capital One issue statements every month so you should be able see what has taken you over - if you have gone over then it was your own fault for using the card to make the purchase.

    If you signed up for online billing you won't get a statement but the website will show you the most recent transactions.

    If you phone them they can tell you the last 5 transactions automatically or from a real person they can tell you what the transactions were for particularly if your concerned your card is being used against your knowledge. You must pass all the security steps first.

    However I am concerned you don't seem to know what its for when there are some very easy means to finding out.
