  • Just telling the op what the salesman told us. He said if they got to our house and they wouldn't fit through the door , they would leave them regardless!

    Hi,

    would someone here know if the DFS agreement is a credit sale or hire purchase sale please?

    My father passed away recently, leavign my mother in severe financial difficulty and one of the creditors is DFS and unsure if this is a non-priority (credit) debt or priority (hire purchase). Also she really doesn't want the sofa to be taken away.

    We have already been to CAB for advice and have the letter templates etc and are about to do the whole token offer thing. my mother has been reduced to pension only so really can't afford the debts.

    Just need to fins out the form of contract with DFS because my mum cannot find the agreement anywhere :angry::angry::angry:

    Anyway - thank you for any advice.

    I would NEVER buy again from DFS total rubbish!!!
    I would go back to the Manager and tell him sorry credit was refused which they are fully aware of so no funds to purchase the suite..( I dont know if law changed now but many yrs ago I was refused credit for 3 piece suite and suite got automatically cancelled ) .they are salesman and will probably threaten and bully you... BUT DONT GIVE IN..fight back Good Luck

  • I am a member of Which? Legal Service it costs about £12.00 a quarter and when you are talking about these sums of money it seems a drop in the ocean ( you can just join for one quarter as you can cancel after a few weeks - or be clever and do it towards the end of the quarter). Phone them up and speak to the lawyers there. They are brilliant and really knowledgable. They explain everything in plain english and are a valuable resource too. They will tell you where you stand with DFS and will also tell you what to say or what to write. They are an arm of the consumer magazine Which?

    They seem to have an offer on at the moment £34.00 for the whole year. It is a lot cheaper than we pay by DD

    We have used them loads over the years and we were in court this week over a faulty pushchair and we won! Yeah:j:j:j

    We wouldn't have got that far if they hadn't been there to help and support us and coach us with legal jargon....

    I think that's in the case of the order being cancelled and the sofa turns up anyway. Which is highly unlikely.

  • i would phone head office asap and explain that you cannot afford it without the credit, the order should never have been placed without the credit agreement being accepted. cancel in writing , fax it to head office if you can. if they insist, then you tell them you will not accept delivery. they would be very foolish to leave goods at your door without your signing for delivery or indeed paying for the goods. i find it hard to believe that anyone would hand over goods without your paying for them or having a signed agreement to pay. if your credit application was refused by them then how can they hold you to said agreement. as i said the guy is gonna try his best to retain the sale so go over his head and contact head office.

  • any further problems and you can contact trading standards or c a b. i dont know where you live but our local authority has a v good consumer affairs dept. i personnally would no take the store managers word for it as i have had similar problems in the past and they will lie cheat steal and sell their grannies to retain that sale
