    I would ask for a reason for being declined, they cannot say "don't know" they must find out and call you back - it may be a generic answer such as "credit data" or "credit scoring" or whatever.

    If you agreed to pay for it on finance and the finance is declined, then i assume the order is declined. Asking you to pay in full is a bit out of order! The purchase was agreed an is most likely subject to approval of finance in the same way as it would be subject to approval on a credit card or switch !!

    the reason i found this thread was because we bought £2500 worth of sofas last night from DFS. Having just watched a programme about people losing their homes etc. etc. we have discussed it and are now wondering if it was really the best idea. we dont need a sofa and although was can afford the interest free payments, what if something happened financially ? in the current climate things are going to get worse before they get better so we are going to ring tomorrow and cancel the order.

    do we even have the right to cancel the order ???
  • We got a sofa from dfs 3 months ago and i'm really happy with the sofa and with the service we recieved.

    In response to post 13 , no i don't think you can cancel once you'v signed the contract. we were told this before we actually signed the contract , that there was no backing out as it was a made to order product.

    I don't really agree that a 0% credit card is the best option. What's the point in paying the 3% balance transfer fee , however many times you do it, when you can just pay a low monthly amount over how many years you want for 0% interest? no fees no lump sums. I think they offer a good deal , esepecially if you go for a half price sofa (which they always have a good choice off!) then your paying a much more realistic price too!

    Hi,

    You have the right to cancel the credit agreement (14 days). You can cancel the sofa, do this today if you are really sure you want to cancel it but they could sue you for compensation. However, you do not have a cooling off period. If they advise you that it can not be cancelled, advise them that you have the right to cancel and if they can prove that the item has already been made to order then they have no right to compensation as the order was only placed yesterday. Put your cancelation in writing and take it in to the store. If you can get them to sign and date a copy even better. I now its a bit far fetched but if you have someone who can go with you who could take a photo of you handing it over, this is all evidence just incase they sue for compensation. Any reputable store would allow you to cancel. Also do not speak to a salesman ask to speak to the manager direct. If they do sue for compensation then they have to prove that the order wasnt cancelled in ample time and they also have to prove that they couldnt sell the item on. Keep copies of all letters and make notes of any conversations you have and with who, date and time. If they totally ignore your canccelation of the sofa, make sure that the credit agreement is cancelled (they can not refuse this under the consumer credit act and if they try to deliver the goods 2 months down the line, refuse delivery and do not sign anything. I did something similar a few years ago, and they tried everything not to cancel, in the end I threatend to counter sue for distress and did not leave the store until I had made a big hoohar of everything. You may be lucky and the manager may be simpathetic , give them a sob story that you just went into work and lost your job! good luck!

    Surely there must be some sort of cooling off period like there is with most financial commitments. We had a similar situation a few years ago that for some reason we weren't able to cancel. We bought a sofa and chairs but then it suddenly seemed that we had to fork out money for all sorts of other things and being self employed our income isn't very steady so we decided we needed to drop the new sofa. With hindsight we could have paid for it, but at the time my parents were looking for some new furniture so they agreed to buy it instead. We carried on making the payments to DFS and my parents set up a bank payment to cover it. We did get DFS to change the delivery address.

    As to the OPs situation - I'm fairly certain that if you are refused credit then you have no obligation to carry on with the purchase.

    The Manager told me the order was placed yesterday with the factory so cannot be cancelled. He offered to see if it could be placed on hold, or to see if someone else orders the same sofa in the same colour then they could have it, but he said it would be Monday before he knew anything....

    not sure how to proceed....

    Where do i stand if I refuse delivery of the sofa ?

    so if im right dfs take up to 3 months to deliver your sofa but cant cancel after 24 hours of taking the order..he at it .. depends how much deposit you want to lose on this but i would tell them your in no financial state to continue.. tell him your under threat of redundancy and cant proceed with the order..

    You need to put cancelation in writing and go to the store, make a fuss, cancell the credit agreement and say to the manager that as it takes 3 months or so for them to deliver make the items then surely they wouldnt have started work on it yet and to phone the factory and tell them not to make it. Also advise the manager that if he doesnt cancel the order, they will get no mopney out of you (as you have cancelled the credit agreement) and that you will refuse the delivery and that they will have to sue you (for compensation only, not the full cost of the goods) to get any money and you will defend your case vigourously as gave them ample time to cancel order with the factory. If they refuse to cancel the credit agreement ask for a reason in writing and if they refuse to cancel the order also ask for a reason in writing. Advise the manager that if he doesn't cancel these you will come back every day and warn customers of the bad customer service and the experience you have had and will not leave the store until cancelled (nothing wrong with threatening this even if you dont follow through or at least start going round the store advising people not to buy and tell them your experience. Only refuse the delivery if you managed to get the credit cancelled otherwise your stuck with your order.

  • If you refuse delivery they will leave it at your front door! We had to check and double check measurements as a door is small and the salesman told us then that if it doesn't fit through the door they'll leave it there as it's now our property not there's and they won't take them back!

    So if you refuse delivery and you refuse to SIGN for delivery and they leave the goods on your doorstep, then these become unsolicitated goods and therfore unless the retailer arranges collection (as you had previously tried to cancel), with in a set time limit they become yours for free (as long as the credit agreement was cancelled).

    I do however doubt that if they turn up on your doorstep and you say "no thats not me, I dont want them" and close the door, they will leave them on your doorstep.
