A buyer reporting a problem from something bought in April

    You charged too much for an old laptop in the first place (new ones for £250). I would expect it to work for at least a year, so I don't blame her for making a case. She should take you to small claims and ask for a partial refund plus costs. To avoid this, you will then refund her money. Easy, isn't it?

    I dont think the law works like that "she paid more than i think its worth therefore she will be able to win a claim at a court, so refund her' :rolleyes:

    SOGA applies to second hand also (cars anyone ?) - the item should work for a reasonable period of time after purchase. Its that "reasonable period" which is the only cause for dispute.

    You can't say anyone paid too much - it was worth what the buyer was prepared to pay.
  • A 6-yr old laptop still working from new would be a stretch of the imagination.
    And April to December is 8, not 7, months btw - surely even paypal would find this hard to swallow

    Section 14 though, so longer as the seller is not a business, isn't applicable at all. S.14 addresses goods being of a satisfactory quality. Even business selling 2nd hand can point to case law about a lower standard being accepted for 2nd hand. Buying a motor from a man in the pub is 'buyer beware'.
