loan company still taking payment whilst ppi is being processed

    i tried to cancel i phoned my bank and they told me there was no direct debit or standing order in place, my bank told me the loan company have your full bank details to take payment which i never knew about..

    Do yo have yr ppi with the loan company? If you didn't give the loan company yr details how did u propose to make repayments?
  • yeah i have a ppi with the loan company.. there was a direct debit setup with the previous company but they went into adminstration, another company took over and i dont know how they got the details, they must of got them from the previous loan company.

    Of course they did otherwise how would you have paid them and I read yr earlier post asking if u can get yr premiums back from them due to the fact you didn't give them yr details, it doesn't work like.....they took on yr debt so yr details are transferred to them....i cant understand why yr bank is saying no agreement in place, if that was the case yr bank have no right to give money out of yr account, however i do not believe their is no agreement in place..u need to go to yr bank and ask them to explain exactly what is in place...........
  • the loan company are using my card details to take money from my bank.. all they need is the long card number and you can withdraw money without an agreement with the bank..and thats what they are doing..

    i aint asking for the full premuims back just todays because it should be going through ppi.. i had a conversation with someone from the loan company saying no more payments will be authorised as they will shred the card details they hold of mine..

    write a letter to the loan co & give a copy to yr bank....2moro fone yr oan company & insist speak with a manager, if they try to fob you off with callback tell them no as u never rcvd call back 2day, make sure u take everyone's name (not just first names), be polite but firm

    Get your bank to cancel your card, and reissue with a different no.

    Also a company can make a customer not present transaction through a PDQ but only with your permission - if you did not authorise the loan repayments by card, then you can sign a disclaimer to get these payments reversed. It is up to the loan company to then prove they have a mandate from you authorising payment by your debit card, but it sounds unlikely they will have such a thing.
