Watch Refund - Help Needed

My sister was bought a watch for her 18th birthday by my parents almost a year ago. Since purchase the watch has been sent for repair 5 times with the watch being away for almost a month at a time for each repair.

Over Christmas the watch broke again, for clarity the issue is the same each time, a screw on the braclet becomes loose and eventually falls out.

Understandably my sister (and parents) are pretty frustrated by the whole issue. Each time they have been back to the retailer they have been told that after the first 28 days the matter is looked after by the manufacturer so the only course of action is to send it for repair. It is at the stage now where they want either a refund or exchange. I have offeed to help them out by taking the watch back but wanted advice from the learned board members.

What are our rights in this situation? Is this matter covered off in the Sales of Goods Act and if so what does it specifically say? Want to go in with an informed approach as really feel the retailer is acting irresponsibly.

    Have you tried speaking to trading standards? That would be my first port of call.

    In these circumstances, the watch is clearly not of satisfactory quality within the meaning of s.14 SOGA. You have the right to a refund or replacement as clearly they are not effecting a lasting repair each time.

    Your remedy is with the retailer. It will actually be your parent's who have to sort the situation as it is them that entered the contract. That said, there is nothing to stop your sister enforcing their rights on their behalf.

    Unfortunately you cannot demand a replacement, but you can demand a full refund. I wouldn't recommend a replacement if she's had so much trouble anyway. Get a refund and get a different watch from a different retailer is my advice.

    From the probelm description, it's the bracelet that is the cause of the problems. Why not just change the bracelet? Or has that already been tried?

    True but why change it? A working watch was paid for and that is what should be expected.
