can i claim under section 75

I went on holiday to America last march.
Booked through tour operator.
Paid money in full before departure.
Flew to America, stayed in hotel where they ask for a swipe of credit card
in case of unpaid extras.
Came home thought i had a good holiday.
3 months later i find my credit card has been charged £1800.
Apparantly this was due to that the tour operator did not pay the hotel the hotels fee and the oversight had not been spotted until sometime later.
The tour operator has since gone bust sometime between after we had come back from our holiday and when we were charged.
And now the hotel have used credit card to reclaim unpaid hotel fee even though i have already paid in full upfront via credit card
