Zavvi Gift Card Problems

  • Does anyone whether you can get your money back based on the fact that the goods (Gift Card) are not fit for the purpose (can't redeem the value), using the Sale of Goods Act. This company is only in administration and has not totally folded (Yet).

    Administration means a company can keep operating for a time without having to pay its debts. The administrators try to find someone to take the company over creditors then have a slightly greater chance of getting some money back. The owners of these gift cards join the list of creditors

    Afraid they are unsecured creditors so their priority isn't that high but higher than the poor shareholders.

    Administration is an insolvency procedure - the company has folded and the shops are being traded by the administrators in accordance with insolvency legislation.

    If the shops are ultimately sold they will belong to a different owner/company who will not be liable for any of Zavvi's debts, including gift cards, although there is an outside chance they may choose to honour them for the sake of goodwill.

    Would this be the same type of sympathy extended to those who lose on the lottery or on a horse (and I speak as a shareholder who has lost out to this banking debacle)?

    Personally, I never regarded the purchase of a zavvi gift card and being in any way a gamble. Was I naive?

    While they still have stock in shops that are still open, I think it would be perfectly reasonable to honour these purchases, and I think it reflects poorly on Ernst & Young, the administrators, that they do not.
  • Being a member of the general public who has a £50 Zavvi gift card I decided to run a survey to find out how much money Zavvi has stolen.
    I have therefore setup a survey at http://zavvi.computernetz.co.uk where members of the public can enter in the value of their giftcards. The site will then show how much has been registered and how much Zavvi owes the owners of the giftcards. Please note that this is by no means related to the administrators or Zavvi you should still try to get your money back from the administrators using the address on earlier in this thread as well as on my website

    !!!!!! why does everybody dig out the Sale of Goods Act, and try to twist it! Clearly this isn't what "fit for purpose" relates to.

    The administrators have given the best advise - you can't get around it... unless you slap the gift card down on the counter and walk out with goods to the value - I've heard of a few people doing this and getting away with it, but it's not clever!

    The act relates to to any single item over £100 so the card company could argue that 4 gift cards are separate for the purposes of claiming. Mute point and possibly would not happen but it could if the card company decided to fight.
