unfair neg received - anything I can do?

I've currently got a dispute open for a non-payment. The item was purchased via BIN about ten days ago so I cant file for a full claim just yet.
The 'nice' buyer has left me neg and claims to have sent payment, via check/postal order and that the item was received by them, stinking of cats, and has sent it back for a refund. Funny thing is, as I've received no payment, I've not even shipped the item yet! Its still in the house! Second thing, I don't even own a Cat :mad:
Thirdly, this is the first actual contact I've had from the buyer - I've sent two invoices (a second to explain that payment made after a certain day could not be guarenteed for xmas - just incase they wanted it for xmas) and I sent a polite reminder just before the 7 days were up, saying that I would hate to open a dispute and I hope we can sort out the problem without resorting to that. I hear nothing, so open a claim and low and behold, a Neg.

It's highly unfair and it's very obvious from the fact that the neg was only left AFTER the dispute, that the buyer is lying and contradicting themselves (they say paid by postal order and the Bank's confirmed it's been cashed :rolleyes:....hmmm...)

Is there anything I can do short of asking the buyer to remove the neg? I've replied to the feedback stating payment never received and dispute open but I'm concerned as its xmas and that neg is going to stay on the top of my feedback for a while as sales are already slowing and are bound to slow for a while longer.

    You can't get the neg removed unfortunately unless you can persuade the buyer to withdraw it.
    so I cant file for a full claim just yet.

    Not sure what you mean by this, there is only the NPB dispute and if you have opened that then there is nothing else you can do until day 8 when you can close it. However if the buyer has responded to the dispute it should be possible to close it now and reclaim your FVfs and give the buyer a strike, if not then keep your fingers crossed that they do not respond as if you can get it closed on day 8 without a formal response their negative will be removed.

    yeah, thats what i mean, I claimed a NPB, not a non-reciept claim - and they have already responded saying they've paid and returned the item (even though I've not sent it).

    it's a shame as my feedbacks dropped a whole 3% because of this. The buyer didnt even bother to contact me until now. Needless to say I've relisted the item already

    lucky the worst I got was the unfair Neg - at least I've not lost money/item.

    1. You can respond to the feedback comment saying payment not received so nothing to refund.
    2. Negative feedback goes with the territory; and 100% doesn't necessarily mean fully kosher anyway.
    3. All the buyer has done is fail to con you and post some feedback; it's not the end of the world.

    Buyer sounds a liar so he will say he has paid you and ebay dont care what you say unless you have an email from them showing evidece that they have not paid(they need header details etc, not just forwarding email). So unless you have this feedback will probably stay .
    I would just follow up his feedback saying you never paid. item still with me!
