Argos

I bought two lights from Argos back in August 2003.

Earlier this year both of them went faulty and i took them back under the 1 year guarantee and got two new replacements.

In October one of the replacements starting to play up so i contacted argos and they said that although the item was only 6 months old - the 1 year guarantee started from the original purchase which i thought was wrong because these were a new set of lights.
They said to contact the makers.

We contacted Trident who make the lights and they agreed with my feelings about the lights should have got a new 12 month guarantee and to go back to Argos.

Argos still said the same and then tried to contact Trident.

In the end Argos kind of stuck to their guns but offer another replacement as a 'goodwill guesture'.

We wanted a refund really for both lights.

Now if either play up we are stuck with broken lights.

At £49.99 each i'm not too pleased with Argos on this.

Does anyone agree or any i wrong?

    ..I'm not absolutely certain about this, but I believe that a seller is able to reduce the guarantee period in line with the original purchase date on the replacement goods (it's probably under their terms of sale).

    However, the guarantee is not your only recourse because where goods bought after 31 March 2003 prove defective within 6 months of purchase, there is a presumption that they were defective when they were bought, in which case the seller is in breach of contract (s14 Sale of Goods Act). I don't know if the replacement goods broke before 6 month's use, but if they did you may be able to return them under the Sale of Goods Act for replacement or your money back.

    As I say, I'm not certain about this, so maybe someone else can be more helpful.

    If you have goods replaced because they are faulty, their guarantee period and any Sale of Goods Act protection would run from the original purchase date.

    But SOGA protection doesn't have a time limit per se anyway - it's about whether the goods were of merchantable quality when they were supplied.
