  • There are several companies that will provide you with legal advice and assistance, mainly because they claim their costs back from the third party insurer. The problem is that they can be more interested in racking up fees than actually doing their job; I have seen several instances where no win no fee solicitors issue unnecessary letters to customers and third parties (at £50 a go) just to up the fees.

    Here is what I suggest:

    1. Make sure your motor insurance does not include legal cover
    2. Check your home insurance to see if you have legal cover there
    3. If you are a member of a union, check whether they provide cover
    4. Speak to your employers to see if they have any kind of staff cover
    5. Ask your employers whether their solicitor knows someone who would take the case on
    6. Go to your local CAB to see if they have a tie in with anyone

    Only after that should you speak to a "no win no fee" company.

    Having said that, £500 is just a throw away offer so you should feel free to reject it.

    They don't tend to do that now that there are fixed fees for RTA cases.

    The presence of any other legal cover available to the OP should be checked in any event by the solicitor before any ATE insurance agreement is signed.

    Not all claims management companies are to be avoided at all costs. I would not recommend a friend to seek advice from a non-specialist RTA/injury lawyer - and even if the claim ends up with one it's highly likely to need funding with an ATE policy anyway.

  • no he is just a childish prat. who evidently pops his head up whenever sex is mentioned and snigers like a schoolgirl at someone who admits to Mental health problems , possibly because i would be an easy target.

    again i wish to thank those on this board who are usefull and helpfull as i have been reading them for quite some time just wanted clarrification upon this issue.
    i will be helping with some food based money saving in the future.
  • It is still early days since your accident. You have no idea what the long term damage may be, it isn't always obvious right away. I recommend what others already have, plus - document everything, keep receipts - including any meds for your injury, contact your local physio/GP for investigation, and a very good legal person who specialises in this sort of thing.

    I have been involved in a similar situation when I was involved in RTA in January 2007.

    I contacted a No Win No Fee firm and was asked all the details over the telephone and instead of sending the paper work in the post, they sent someone to my place, placing pressure to sign the contract immediately.

    I read the contract of No Win No Fee and found that there were clauses regarding "success fee" if not paid by the third party insurers and that I would be liable for it. I was not happy about this.

    As the third party insurers had already admitted liability whilst settling my car claim, there was no problem, and hence I asked the legal firm to put it in writing that I would not have to pay them anything extra such as "success fees" nor they would deduct any amount from my claim.

    Although their representative, who has now left the firm, have confirmed this via email, I will have to see what happens when the claim is settled.If they do not adhere to our agreement, I would have to report them to the appropriate authorities.

    My spouse and myself were asked to go for medical examination and the report which followed was rejected by us. We were again sent for another medical examination, and I have accepted my report but my spouse refuses to accept her report as she has injury that is severe and is in constant pain.

    Initially, I was told the legal firm that I could expect around £1,500 for whiplash injury, which was renegotiated and increased to £2,500. I still have 15% loss of mobility of my head, and have now been offered £3,500, which does not take into account the marital life has been spoiled, the tension, inconvenience, and the constant pain I would have for the rest of my life.

    The correspondence from my legal firm seems to be handled by newly qualified "legal executives" with no experience (which I believe is normal for these firms) and I have to tell them what to do. At times, they have even threatened me that they would not take instructions from me to proceed further, and I had to tell them that they are employed by me to do what I ask them to do and not otherway round.

    I now intend to seek second opinion from another firm of solicitors about the way this firm has handled my case.

    I understand that there is a 3 year time scale within which one can take action and I believe, once the ball is set rolling, the matter can not be closed for atleast 6 years till the last letter sent to the parties concerned.

    I suggest that you speak to SAGA and DEMAND that you need IMMEDIATE PRIVATE MEDICAL ATTENTION and that you are not willing to wait for NHS treatment.They are also duty bound to offer you IMMEDIATE physiotherapy treatment.

    Check out the No Win No Fee legal firms on the internet, speak to them, get ideas and find one with which you are comfortable. Ask who is going to handle your case and get confirmation in writing that you would not be liable for ANY FEE, including SUCCESS FEES nor they would deduct any amount from your claim.

    Keep record of all the corresondence and make notes of your telephone calls including dates and time, to everyone involved in the matter.

    Do not rush the matter as it is now most important that you seek medical help at the earliest and leave the question of compensation to take its time.

    Be patient.
