Problems with ebay user, whats the next step...

i should take?
Heres the story.
I won this item on the 13th of nov....

you are bidding on a genuine
corsa rear bumper
did have small crack behind number plate
has been plastic welded
I won the auction
Sent him an email on the 14th with the following....
"can you confirm your postal address so i can send a cheque in the post tomorrow.
Also the only mention of damage was behind the numberplate, which you said has been fully repaired and obviously this will be hidden behind the number plate.
I take it that the bumper is in good condition apart from the fixed crack behind the number plate.

So i sent my cheque off.....
RECEIVED THE BUMPER TODAY, NOT ONLY IS IT FULL OF DEEP DEEP SCRATCHES ON THE SECTION THAT I OPENED BUT ITS ALSO fcuking PINK!!!
The bumper that i have recieved is not what was stated in the for sale discription!
What am to do now?
I sent him an email straight away saying the following....
"RECEIVED THE BUMPER YESTERDAY
THE SECTION THAT I OPENED ON THE BUMPER IS FULL OF DEEP SCRATCHES AND IT IS BLOODY PINK!!!!!!!!!!!!!!!!!!!!

I agree that the wording of the auction is dodgy, it isn't what it says but what it *doesn't* say that is interesting.
Although it mentions the repaired crack it doesn't say anywhere in the auction that the rest of the bumper is fine, in fact he doesn't mention the overall condition of the bumper at all and that is something that should have been checked before bidding. As for it being pink, I think although not specifically mentioned in the auction you could reasonably have assumed the bumper to be the same one as in the photo, and that doesn't look pink to me.
I would also have taken note of the negative feedback he has already received for selling a badly scratched bumper, that might have been enough to put me off bidding on a similair item.
As for what you can do now, the bad news is I think you are stuck with your pink bumper. Ebay will not be particularly bothered by the fact that the item was not what you were expecting, the seller could also make a complaint about your swearing in a mail to him, something that ebay do not like. Even if the seller agreed to a refund he might try and hold onto the postage costs of £20 so by the time you send it back at your own cost you will be well out of pocket.
If you want to pursue the matter then firstly report the seller to ebay, use the following link:

..and there is an option for making a report as the item 'wasn't as described'.I don't know if anyone has had any success with making a report on that basis but it must be worth a try.
If it cannot be resolved then you have the option of leaving a carefully worded negative which will really hurt his rating, he already has only 97.3% another negative will make that much worse. However, he can of course neg you back but as you are new to ebay it might be worth closing your account if he negs you and opening another one and starting again.
Secondly, there is no harm in sending another e mail politely requesting a full refund on the basis the item was not as described..after all it is pink!

That is the swearing i was referring to, ebay are surprisingly moral when it comes to bad language.
I still suggest making a complaint to ebay on the grounds that the item is not as described. You could also try pulling the sellers details and giving him a call to see if you can't sort it out by phone.
