    but the spec argos puts up doesn't say it can download music does it which is what you buying on! also it does say this is excluded from the 30 day Money Back Guarantee the only thing you maybe covered on is the distance selling rules as you asked for a refund on the day of reciept of goods i would threaten them with trading standards and see if that makes them listen as use the distance selling rules as your angle and point out was done on day of reciept of goods and failure to do so breaking the law etc etc

  • the reason they dont take things like this back is because they cant sell it n to anybody else if you have stored photos etc on it

    if you take it to a store and just be nice about it im sure they will do all they can to help you... they will have to phone head office for authorisation but im sure they will try and sort it for you
    i think half the time when trying to deal with customer service via email they dont take it seriously as you are not there to argue back ;)

    im surprised they're not helping you out though as when i worked there most people would return it to a store and say its faulty and the quality is so poor they dont want another, hence get their refund - youd think argos would much rather have the item go back on the shelf then in the returns and lose money on it

    You have a right to return any item as long as you cancel within 7 days of delivery, which you've already done. This is a right given to you under the Distance Selling Regulations.

    It's even mentioned on Argos' website that you can do this:

    "Under the Distance Selling Regulations, you have a right to cancel your order for any item purchased on this website for a full refund [...] within seven working days"

    I would advise that you send them another email referring them to their own webpage stating that you're allowed to return the item. It may be that the people you speak to/email aren't aware of this but either keep persisting until you reach someone that does know or call them and ask to speak to a manager who I would hope is is more in the know about customer law.
