Argos Direct!!!!!!!!!

Hey all, hopefully someone may be able to help with my problem that I am having with Argos Direct. I recently bough a Digital Photo Frame off their website as a Christmas Present. Upon receiving the product there are 2 main Issues.

1. I am not happy with the quality of the product

2. On their listing for the item on their website, one of the customer Reviews reads "you can also download music onto it" (This was a major selling point for me). This statement turned out to be completely false, and you cannot download music onto the item.

Detailed is a list of how the whole process has gone so far:

29th November - Item Ordered

2nd December - Item Received

2nd December - Refund requested by email via the Argos Website

2nd December - Email received from Argos saying that because the item isn't faulty they cannot offer a refund as the item is not part of their 30 day money back guarantee.

6th December - Another eamil sent to Argos to highlight the incorrect information that is on the item listing.

7th December - Email Received from Argos saying that there is nothing they can do as teh item isnt covered under their 30 day money back guarantee, and that unless it is faulty their system wont allow them to generate a return.

9th December- - Email sent again expressing dissatisfaction with their reply and asking them to reconsider and for the email to be passed onto a senior member of staff.

12th December - Emailed Argos again, as I was still waiting for a reply to my previous email. (They say they try and answer all queries within 48 Hours

16th December - Emailed AGAIN as I was still waiting for a response

17th December - Received reply from Argos at last, however the email isnt intended for me it is for a Mrs Howard (Whoever she is) telling here that they are looking into the missing items she has with her precision drill set!!!!

17th December - Emailed Argos again, explaining the above was nothing to do with me and to inform them I am still awaiting an answer from my email on 9th December.

I am still waiting for their response to my previous email.

I have read about the distance selling regulations and surely the Item is covered under this? Why are they so reluctant to allow me to return the item??

Any advice or help would be greatly appreciated.

    Have you pointed out that a customer review states that it allows music to be played, yet this turned out to be untrue? I think that may qualify it as "Unfit for purpose" and therefore can be classed as faulty which would entitle you to a refund.

  • I have pointed out about the customer review and their response was:

    "The reviews that are posted on our website are made by our customers therefore we cannot take any responsibility for their reviews. It may be that the customer left the review on the wrong item by mistake."

    I'd say that you were covered by distance selling rules, and the misleading review (unless they have a disclaimer anywhere about customer reviews).

    It's the first review there. I wouldn't be blaming Argos on what a customer has stated though.

    I'm sure that Argos have a responsibility to ensure that customer reviews are not misleading, they can certainly be held responsible for inaccurate information therein.

    The customer review does not say the photo frame can play the music file. ;)

    Are you sure the reason the music file could not be transferred was because it was larger than 10MB? Have you tried with a smaller file?

    The OP hasn't mentioned anything about playing a music file though :confused:

    They said they can't download onto the item, when the review says you can.
