Problem returning something to Comet

BT is right, your contract is with Comet, you need to get in there when there are other customers around. Tell them to test it in front of you.0
-
Right, I have sent them a letter. Thanks for all your advice.
I'll let you know when/if they respond.0 -
Also if you bought it on a credit card, get onto them and they should be able to get your money back for you.0
-
If you confirmed with the sale man at the time you wanted the handsfree feature for this purpose, or you checked the spec included a this feature then Comet are totally responsible and should sort it.
Stick to your guns. Perhaps print off some legislation documentation from the internet and give it to the manager to teach him his responsibilities.

What happened about this - as I am having problems returning a faulty Bissell Cleaner to https://www.247electricals.co.uk - who are passing me around the mountains, and I am getting fed up!!!
I would like to know if a letter works... as they have no phone number on their website (how nice for them!!) so can ignore all the emails...0 -

After a bit of searching I found this number for them - not sure if it works 0207 5933400, try changing the last digits all the way from 00 to 09 as their fax ends 10 so I would assume all the rest are extension numbers. Good luck.0 -

There's also the:
Distance Selling Regulations (DSR) 2000.
Consumer Protection (Distance Selling) Directive 97/7/EC.
and
Electronic Commerce Directive 2000.
(Other consumer legislation may apply according to circumstances)
The DTI's factsheet is at:
http://www.dti.gov.uk/ccp/topics1/facts/distancesell.htm
"Q5. What should I do if the goods are faulty?
The Consumer Protection (Distance Selling) Regulations 2000 give consumers an unconditional cancellation right, in addition to their rights under the Sale of Goods Legislation.
Where a consumer claims goods are faulty after having had a reasonable time to examine them (which could be after the expiry of the cooling off period above) the consumer's rights under the Sale of Goods Act apply.
The Act makes it clear that if the goods do not conform to contract and the consumer exercises his or her right to reject them, they can ask for their money back, providing they do so quickly. Alternatively, they can request repair and replacement or claim compensation.
Please see the Sale of Goods factsheet for further information from www.dti.gov.uk/ccp/topics1/facts/salegoodsact.htm."
Under:
The Consumer Protection (Distance Selling) Regulations 2000
Statutory Instrument 2000 No. 2334
http://www.opsi.gov.uk/si/si2000/20002334.htm
It says....
Written and additional information
8. (2) (c) the geographical address of the place of business of the supplier to which the consumer may address any complaints;
In the case of 247electrical it can be found on their "About Us" page.0 -

Okay, I got a reply from the Head Office saying they stood by the store decision but that I should take it back to the store for testing again.
So I did. A few days later I called and they had tested it and found it was faulty after all and I could go and get a refund.
When I got to the store they asked where the box, cables etc were and I stressed that I had returned it all complete. The staff have had a really bad attitude throughout this.
OK so I had to push and finally got my money back. I will never, never buy from them again. Over the last 15 years every TV, washing machine, fridge freezer, printer and vacuum cleaner I have owned was from Comet and I never had a problem before. They must realise that alienating customers is not going to help them win more business.0
