Yellow Line Query

Can anyone can tell me if I'm committing an offence if I park my car with the tyres inside the yellow lines but the body of the car over-hanging the lines.I can't seem to find any info in the Highway code or on any of the parking sites.

It is possible to win with a claim of 'de minimus' ie.e of little or no consequence.

More importantly, need to see the PCN - ALL of it and preferably pics of signs, lines and the event if you have it.
At the very least, tell me which Council.

We're talking about Yellow lines not white ones

Sorry, though they went hand in hand.

I thought it was all about the tyre position. If they tyre isn't on the yellow line it should be OK?

You think, you thought? Are you making it up as you go along or was this from 'bloke in pub' or 'someone once told me'. To back it up with fact might make it more credible?

The applicable legal terminology is mentioned above along with a suggestion and question that could possibly win the case on other grounds.

Thanks for your useful post, I gather from that it is different for every parking situation? (Ie: sometimes you might be able to get away with it but others not)

It is a debatable point that isn't really defined in law very well. There will, though, be adjudications on similar matters and yes - every case is different.

just seen a Council 'surrender', I think I recall, on a similar issue, before it progressed too far.

Point is, it will be a useful issue to raise but much better to accompany it with serious legal flaws. Seeing the PCN and pics of the event are important but if OP can just tell me what Council I can tell a lot from that.

I haven't got a PCN yet!...its just something that has bugged me in the past as to whether its the tyres that have to be outside the yellow lines or the whole car as most cars over-hang the rear tyres by something like 2-3 feet.

It is one of those things that is down to mood and character of a CEO and then after that, how awkward a Council want to be.

If you overhung by 3 ft as you say is possible then CEO would probably issue a ticket. Then again you could be in a car with rear wheels set a long way back, have the wheels actually covering e few inches of line - and they might or might not.

Most important thing to remember for these circumstances is that the appeals process is a pain, takes time and that for such an issue a Council would be unlikely to back down IME. You would then have to wait for Adjudication, cailm 'de minimus' and quite possibly win or, more often than not, the Council will pull out at the last minute.

If it was an FPN under criminal leg. then your only recourse is to plead with a Magistrate - not a good idea at the best of times and certainly not for that.

Conclusion - avoid testing the matter and don't get a ticket - too much trouble.
