Lloyds TSB wants to charge for accidental overdraft

My wife recently went overdrawn by about £3 on her bank account and now they have sent her a letter saying they will be charging her £27 for doing so. We immediately put the account back in credit within two days. When she challenged them about it saying the charge was illegal they said it wasn't. What does she do next?

  • Pay the charge and run her account more closely in future ;)

unfortunatly as she has no overdraft facility (which would be why they charging the amount) its an unathorised over draft charge, as the other postr advised, i would suggest that she pays them, after all she breached the t&c's wether intentional or not, and perhaps see if she can get a small over draft ie £50/100 and then at least if she accidently does go over again, she wont get charged so heavily

I have no idea why we seem to have people who are accepting that a bank charge is fair because it is for a breach of the terms and conditions:rolleyes:. The fairness of bank charges has not be decided on. The bank are right on one aspect, it is not and has never been ILLEGAL but is possibly UNLAWFUL(subject to the conclusion of the OFT Test case). She needs to read Martin's guide to reclaiming and start the process of reclaiming her bank charge(s).
