:mad: I had a car accident in May of last year when I was hit by a car travelling towards me. Luckily I saw what was about to happen and swerved away from the oncoming vehicle so that it only caught us with a glancing blow to the rear wing. Although at the time it seemed like a nothing accident the car cost over £1500 to repair - obviously this was through an insurance claim. However i've just been contacted by my insurers to tell me that they've been unable to reclaim the costs from the third party's insurance because she had a tyre blow out - therefore she couldn't be held responsible for the accident (it is my belief the tyre blow out was caused by her hitting the kerb on the roadside at over 50mph and the fact that her car was in a poor state - never got to look at the tyre before it was replaced on her car though by a friend of hers who turned up within ten minutes of the accident). As such this means the accident goes down as a fault claim on my insurance which will effenct my insurance premium. Is there anything I can do about this?
My car, before the accident, was a really nice car - full service history and ran great, never any problems. However, since the accident, it's been a different story with no end of problems - the brakes have never been right since and the car generally sounds like a bag of spanners even when out on a leisurely drive. Is there any chance that the original smack may have done more damage than I first thought?
