CC Charged although goods not in stock

Can anyone help i purchased some items from a company for christmas website said they were in stock, however got email a few days later to say items would take approx 2 weeks as they weren't in stock, said fine, i can wait 2 weeks, however on checking today they have taken payment for the all items despite not having them in stock, are they correct to do this, most companies i've ordered from do not take payment until the items are instock ready to despatch.

    Some companies do take immediate payment, there's legally nothing to stop them from doing so, however under Distance Seling Regs they must provide your goods within 30 days or refund the payment.
