New TV set faulty, what are my rights?

I have just sourced and bought a LG LCD TV online and managed to get it £240 cheaper than I have seen it elsewhere. I ordered it 29/12/05, it arrived 04/01/06 and by 07/01/06 I noticed there was a problem with the colour bleeding. I contacted the supplier, Pixmania.Co.Uk and LG and both advised it be returned. Pixmania said they would arrange collection on 09 or 10/01/06 and as I had notified the problem within 7 days I could have a refund or exchange. Great I thought, however I am still waiting for them to collect the TV. I have taken 3 days off work this week so far and made numerous national rate call to Pixmania customer sevice team. They have said they are arranging collection but still I have received no word. I'm getting fed up now and don't really know what my rights are or what I do next if they fail to collect the TV and refund my money. It's a shame because this problem aside I was really pleased with the service, TV etc. Can anyone advise please?

Contact them again by phone and see what they say. If they don't collect the tv at a mutual convenient time soon, I would then write a letter sent recorded delivery to them giving them 7 days to pick the tv up or you will reject the goods under the sale of goods act and mention that you would expect a full refund or go to the small claims court.
Be polite but firm explain you have already taken time off work and that it is inconvenient having to wait wait in the hope somebody comes round to pick the tv.
Its always best to give companies reasonable time to respond and do things in writing preferable then if worse comes to worse you can demonstrate to a court that you have been more than reasonable.
Sometimes it best to pay by credit card for high value goods as you have some comeback on the credit company rather than debit card.0 -
Remember Pixmania is a French company, and the T&Cs state that French law will apply.

Yes I realise they are a French company and am not sure how that affects my position. I must say though I am toying with the idea of taking the goods back to their shop in Fulham if I don't get a collection date soon.0

UK law over rides any terms and conditions. If the goods are not fit for the purpose or of reasonable quality then one would expect a full refund or replacement withina reasonable time frame.0
