Claiming back charges from HSBC

I understand that all claims are on hold, but was wondering whether I came under the financial difficulties part. I have had £775 worth of charges in 1 year and 7 months since I claimed back charges in Feb 07. I have been without a job for a month and a half and have just got a job where my income will be around £300 less than I was receiving. I am having difficulty paying my Credit Card minimum payments because of this, I live with my partner and all outgoings like mortgage, energy etc are under his name, so don't know if I can prove my outgoings.

This money they have charged me would take me into the black on my account or pay off one of my cards. So would be extremly helpful.

  • The likelyhood is that the bank would assess both incomes if you are claiming back charges on both accounts. I would look at the FSA Waiver on Bank Charges, and annex 2 PAGE 11. If you feel that the criteria mentioned is something that you fall within then write to the bank, if you haven't put a claim in, or write with reference to the claim you have put in and state that you are in financial hardship as defined by the FSA Waiver annex 2 because of the specific issues that relate to you.
    Hope that bit makes sense? The bank are under no obligation to pay out but they may do or suspend/waive bank charges until the conclusion of the OFT test case.
