Got told off for posting on the techie forum.

Bought two laptops from Dell last Monday. Have been trying to cancel since last Saturday. Original date for delivery was 23rd of December. Anyway they say they've now sent them and I have to pay £40 + vat to cancel.
Someone guided me to the OFT Distance selling which says you have 7 days to cancel.
Tried to tell Dell this and they just said they go by Dell terms not the OFT and I have to pay the £40 + anyone know if that's true?

    Bad Dell! They have to abide by UK law, like everyone.

    You have 7 days from RECEIPT of the goods to cancel. You probably have to pay return postage if you accept them when delivered - so just *refuse delivery* - (and best not to sign anything from the delivery man - though he probably wont ask you - just tell him the order was canceled).

    I'd make sure you write to them by email and letter to cancel (by signed for delivery for a few pence) as a phone call is NOT sufficient. Keep a copy of what you send and the 'signed for' receipt.

    "Your right to cancel, or the 'cooling-off' period
    The Distance Selling Regulations give you the right to change your mind and cancel an order within seven working days. If you do decide to cancel, you should put this in writing, either by letter (a proof of postage certificate or even recorded delivery would be wise), or you can fax or email. A telephone call is not sufficient, unless both you and the trader agree otherwise. The time limits are as follows:
    • goods: seven working days after the day on which the goods are received;
    • services: Seven working days after the day on which you agree to go ahead with the agreement."
