I complained about my neighbours dog to council - neighbour threatened me

    Well in that case if you really feel like taking it further you are looking solicitors etc. Unless of course you are threatened and then you do involve the police

    It really might be best you just fence your own property. Maybe not morally fair but stress wise its really got to be the best option

    if you are owner-occupiers and the property is leasehold, surely the council is the freeholder and therefore should have some interest in the state if disrepair of their property?

    Abuse is harrassment - note everything down and report it if needs be.
    If my typing is pants or I seem partcuarly blunt, please excuse me, it physically hurts to type. :wall: If I seem a bit random and don't make a lot of sense, it may have something to do with the voice recognition software that I'm using!

    I don't think the Council really has much say over your fence if both properties are privately owned. It sounds like they suggested this as a way to resolve the situation and to stop the dog from straying.
    The council will not be able to act on you being threatened and unless its formally reported to the police they probably won't let it affect the way they deal with the case other than warning the officer.
    I would build a secure fence around your garden to stop the dog from being able to enter your garden. If you rent the property out then any tenant will soon expect you to do this to stop the dog getting into the garden.
    Also make a compliant to the council about the dog straying in your garden and fouling in your garden. If you have witnessed this then the council does have powers to issue fixed penalty fine for dog fouling.
    It is very easy for people to say you should go round and talk to your neigbours about problems but not every neighbour your friendly with and you do not always know how they will react. Also some neighbours will purposely cause you problems in response to you complianing to them about something. The council will not give out your name to the person your complianing about but when you live next door to someone they often guess.
    It sounds like you may have long term problems with the neighbour and if you get a tenant this might just get worse. You may be better of cutting your losses and selling the house.
    Just remember the council has a duty to deal with your compliant until your statisfed its been dealt with.
  • I would call the RSPCA and get them to go round to talk to them about being a responsible owner because if you own a dog you must maintain any fencing be it yours or not. Or if the owner is out one day and you see the dog in your garden call the dog warden for stray dogs to collect the dog and let them deal with the charge to get the dog back and keep doing this untill he sorts out the fence!
