    You chose the free DVD's and did not return even though you had the choice not accept the T and C's.

    Should you refuse to pay it will be registered and also you will receive a court order. It will ruin any chance of credit for a very long time to come.

    If you have'nt been with them for more than 28 days then I suggest you reject the freebies, if not, then you don't have a case.
    Rememember. Everyone seems normal until you get to know them.
    Never pass up an opportunity to go to the bathroom.

    With respect, why on earth should you get away with not fufilling your contract? Brittania have every right to pursue you for the cost of the goods, you entered into the contract!

    If you don't pay up then its members like me that get stung for the extra. Why should I have to pay for other peoples freebies? Heres the T&C:

    Purchase Commitment
    4.1 You have to buy at least 6 Recordings at Regular Price within the Fixed Period (the two years after you first open a Membership). At least 3 of these Products must be within the first 12 months. NB: The Introductory Offer, free items, sale or Bonus Price Recordings don't count towards your Purchase Commitment.

    4.2 If you don't buy 6 Recordings at Regular Price within the Fixed Period, or if you cancel your Membership before you've bought 6 Recordings at Regular Price within the Fixed Period, you'll be liable to a Compensation Fee. The Compensation fee is equal to the total value of the discount received for your account Introductory Offer.


    I joined Brittania ages ago and paid for the 6 obligated DVDs in my contract, so now I am classed as a full member and can cancel at any time. The trick is, as someone else suggested, look for the cheaper 'regular' priced goods just to fufill your obligation.

    Once you are classed as a full member you can then buy as many goods as you like for the bonus/special price.

    For instance, I just bought 2 Robbie Williams CDs for a fiver each, if I'd bought them from CDWOW they would've cost £8.99 each. Even with p&p it works out cheaper.

    Benefits of Club Membership - loyalty pays
    5.1 As a Club member you can buy an unlimited number of Recordings at Bonus Price at any time.
    5.2 Once you've fulfilled the Purchase Commitment you can buy all subsequent Recordings at Bonus Price.


    They used to do a buy one at normal price, get one at 'bonus' but changed it some time ago though many don't realise this and still buy regular priced goods when there's no need.

    So there, it actually works out cheaper sometimes....if you stick to your agreement that is :D

    Steviep: I'd suggest you take their threats seriously because refusal to pay will cost you far more in the long run.

    Depending on how long this has been going on you could appeal to them, telling them that you will fufill your side of the contract, and ask them to remove the 'compensation fee'. Sometimes they will so its worth asking.

    I wouldn't refuse to pay on principle as they are clearly in the right and you're wrong :p It *will* end us costing you a small fortune in the end so bite the bullet and pay up, or offer to fufill the contract.

    I am finding it hard to cancell my membership with this company. I have tried three times now and they seem not to want to let me go.
    I have cancelled by phone, by e mail and again today by phone so you can understand that i am know very fed up. PLEASE CAN ANYONE HELP!!!!!!!!!

    I used to be with this club and only ever had little problems. It used to be that you could order anything at the bonus price through their website making most of their DVDs/CDs cheaper than anywhere else - this is before the likes of CD-WOW appeared.
    Britannia sent me a returns lable of which the Royal Mail advivised me to copy for future returns, I do.

    It appeared to me that it was a computer reading the emails I sent them, so just by sending an email saying "returns label" they would send me a prepaid label - never thought of copying them though!

    ladeladela: sounds as if you are on the BRATS payroll?
    Who do you think should be liable for the postage of returning c.d's which the BRATS keep deliberately sending out after being cancelled in more than enough time? The last cd i got was cancelled imediatley, but of course i did receive it and sent it back. I am refusing to pay their bill for postage as i do not beleive i should always be expected to pay for someone elses !!!!!!-ups (deliberate or not).
  • I have bought the mandatory number of full price CDs from Britannia and cancelled my account. They are claiming postage in respect of unwanted/unsolicited Cds which I have returned prior to cancellation. I have refused to pay and like others I am now being threatened by their debt collection people.

    Does anyone know if there is a legal liabillity to pay postage costs on unsolicited goods ? Has anyone successfully avoided payment ?

    reading this thread some of the stuff sounded quite familiar, not with britannia but another company, TSP, which does similar offers but with books, i signed up and got 3 books for £1 each if i remember rightly and had to buy 2 further books at normal price before i could close the account.

    after I had fulfilled this i sent an email to close the account which they seemed to ignore as they sent me further books to "sample"

    i emailed them back saying that i had closed the account and wasnt going to order any more books and they said ok once i had sent back the book they sent me they would close the account. now i wasn't going to pay postage for this as i had already closed the account before they sent me this book and i didnt want it at all so i mailed them back telling them they would have to pay the postage. they just ignored this email and then a couple of weeks later sent me a bill reminder for the total price of the book.

    when i received this i was pretty annoyed, so i sent them a further e-mail saying that if they wanted the book back they would have to come and collect it, i wasnt going to pay them a penny or post it back to them as i had already closed the account and wouldnt be entering into any further correspondance with them

    lo and behold the very next day a courier was at my door asking to pick up the book ;D

    When dealing with Britannia I suggest that you check their maths, as we (wife and i) asked them to check what we owed them and they sent us a nice statement (computer printout) and none of the totals added up. in the end we got fed up with them and left.
